A bill for an act
relating to human services; creating emergency grant program for autism spectrum
disorder treatment providers; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin EMERGENCY GRANT PROGRAM FOR AUTISM SPECTRUM
DISORDER TREATMENT PROVIDERS.

new text begin Definitions. new text end

new text begin (a) For purposes of this section, the following terms have
the meanings given them.
new text end

new text begin (b) "Autism spectrum disorder" has the meaning given to "autism spectrum disorder or
a related condition" in Minnesota Statutes, section 256B.0949, subdivision 2, paragraph
(d).

new text begin (c) "Autism spectrum disorder treatment services" means treatment services delivered
through the following service components and modalities:
new text end

new text begin (1) patient psychotherapy, patient and family psychotherapy, family psychotherapy,
psychotherapy for crisis, and group psychotherapy;
new text end

new text begin (2) individual, family, or group skills training provided by a mental health professional,
clinical trainee, or mental health practitioner;
new text end

new text begin (3) crisis planning;
new text end

new text begin (4) mental health behavioral aide services;
new text end

new text begin (5) direction of a mental health behavioral aide;
new text end

new text begin (6) mental health service plan development;
new text end

new text begin (7) children's day treatment;
new text end

new text begin (8) applied behavior analysis (ABA);
new text end

new text begin (9) developmental individual-difference relationship-based model (DIR/Floortime);
new text end

new text begin (10) early start Denver model (ESDM);
new text end

new text begin (11) PLAY project;
new text end

new text begin (12) relationship development intervention (RDI); and
new text end

new text begin (13) additional service components or modalities not listed in clauses (1) to (12) upon
approval by the commissioner.

new text begin (d) "Certified children's therapeutic services and supports provider" or "certified CTSS
provider" means a provider entity certified by the commissioner of human services under
the certification process in Minnesota Statutes, section 256B.0943, subdivision 4.

new text begin (e) "Qualified early intensive developmental and behavioral intervention provider" or
"qualified EIDBI provider" has the meaning given in Minnesota Statutes, section 256B.0949,
subdivision 2, paragraph (q).

new text begin Emergency grant program for autism spectrum disorder treatment
providers.

new text begin The commissioner of human services shall award emergency grant money to
certified CTSS providers and qualified eligible EIDBI providers to support the stability of
the autism spectrum disorder treatment provider sector during and after the COVID-19
public health emergency.

new text begin Eligible providers. new text end

new text begin The following providers are eligible to receive emergency
grants under this section:
new text end

new text begin (1) qualified EIDBI providers delivering autism spectrum disorder treatment services;
and
new text end

new text begin (2) certified CTSS providers delivering autism spectrum disorder treatment services.

new text begin Subd. 4. new text end

new text begin Allocation of grants. new text end

new text begin (a) Eligible providers must apply for a grant under this
section on an application in the form specified by the commissioner, which at a minimum
must contain:

new text begin (1) a description of the purpose or project for which grant funds will be used;
new text end

new text begin (2) a description of the specific problem the grant funds will address;
new text end

new text begin (3) a description of achievable objectives, a work plan, and a timeline for implementation
and completion of processes or projects enabled by the grant; and
new text end

new text begin (4) a process for documenting and evaluating results of the grant.
new text end

new text begin (b) The commissioner shall review each application to determine whether the application
is complete and whether the applicant and the project are eligible for a grant. In evaluating
applications, the commissioner shall establish criteria including but not limited to:
new text end

new text begin (1) the eligibility of the project;
new text end

new text begin (2) the applicant's thoroughness and clarity in describing the problem grant funds are
intended to address;
new text end

new text begin (3) a description of the applicant's proposed project;
new text end

new text begin (4) a description of the population demographics and service area of the proposed project;
new text end

new text begin (5) the manner in which the applicant will demonstrate the effectiveness of any projects
undertaken;
new text end

new text begin (6) the proposed project's longevity and demonstrated financial sustainability after the
initial grant period; and
new text end

new text begin (7) the evidence of efficiencies and effectiveness gained through collaborative efforts.

new text begin (c) The commissioner may consider other relevant factors in addition to those listed in
paragraph (b).

new text begin (d) In evaluating applications, the commissioner may request from the applicant additional
information regarding a proposed project, including information on project cost. An
applicant's failure to provide the information requested disqualifies an applicant.

new text begin (e) The commissioner shall determine the number of grants awarded.
new text end

new text begin (f) The commissioner shall award grants to eligible providers through December 31,
2024.

new text begin Eligible uses of grant money. new text end

new text begin The commissioner shall develop a list of eligible
uses for grants awarded under this section.

new text begin Federal aid or grants. new text end

new text begin The commissioner must comply with all conditions and
requirements necessary to receive federal aid or grants.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective the day following final enactment.

Sec. 2. new text begin APPROPRIATION.
new text end

new text begin $....... in fiscal year 2023 is appropriated from the general fund to the commissioner of
human services for the grant program established in section 1. This is a onetime appropriation
and is available until December 31, 2024.
