  1.1                          A bill for an act 
  1.2             relating to adult basic education; creating an adult 
  1.3             basic education policy review board; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 124D. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [124D.521] [ADULT BASIC EDUCATION POLICY REVIEW 
  1.7   BOARD.] 
  1.8      Subdivision 1.  [ESTABLISHMENT.] A nine-member adult basic 
  1.9   education policy review board is established to advise the 
  1.10  commissioner on program and funding policies for adult basic 
  1.11  education programs that receive aid under section 124D.531.  The 
  1.12  commissioner must appoint board members to two-year terms, 
  1.13  beginning in October 2000.  Members do not receive per diem, but 
  1.14  may be reimbursed for expenses as specified in section 15.059, 
  1.15  subdivision 3.  At a minimum, the board must hold two meetings 
  1.16  per year.  All other matters of the review board's operation, 
  1.17  except expiration of the board under subdivision 4, are governed 
  1.18  by section 15.069. 
  1.19     Subd. 2.  [MEMBERSHIP.] Members are appointed by the 
  1.20  commissioner.  The commissioner must appoint two members of the 
  1.21  board from rural programs, two members from suburban programs, 
  1.22  two members from urban programs, one member from a nonprofit 
  1.23  group that has knowledge and expertise in the area of adult 
  1.24  literacy, one member who is currently an adult basic education 
  1.25  learner or has participated in an adult basic education program, 
  2.1   and one member who is an adult basic education instructor.  The 
  2.2   composition of the board must allow for equal representation 
  2.3   from adult basic education learners, instructors, and 
  2.4   administrators.  Members of the legislature and representatives 
  2.5   of other concerned groups may be included as ex officio members 
  2.6   of the board.  
  2.7      Subd. 3.  [DUTIES.] The policy review board must: 
  2.8      (1) recommend to the legislature a mission statement for a 
  2.9   statewide system of adult basic education programs that includes 
  2.10  educational outcomes, services, eligible learners, requirements 
  2.11  for teacher licensing, expectations for student advancement and 
  2.12  progress, and recognition of the importance of distance learning 
  2.13  and other technology-based instruction methods; 
  2.14     (2) advise the commissioner on adult basic education 
  2.15  standard policies and procedures; 
  2.16     (3) advise the commissioner on the adult basic education 
  2.17  curriculum and course offerings, including policies to offer 
  2.18  computer literacy and other skill-based education through adult 
  2.19  basic education programs; 
  2.20     (4) recommend to the legislature the minimum number of 
  2.21  contact hours that are necessary in order for the program to 
  2.22  continue; 
  2.23     (5) recommend to the legislature an adequate and reasonable 
  2.24  hourly rate for smaller programs; 
  2.25     (6) recommend to the legislature a reasonable range for the 
  2.26  number of instructional hours or a reasonable cap on the number 
  2.27  of hours individuals may spend in adult basic education 
  2.28  instruction; 
  2.29     (7) recommend to the legislature an outcome-based adult 
  2.30  basic education funding system that rewards and recognizes 
  2.31  student progress in attaining educational goals; and 
  2.32     (8) review statewide grant applications for supplemental 
  2.33  services under section 124D.522. 
  2.34     Subd. 4.  [EXPIRATION.] The adult basic education policy 
  2.35  review board expires on September 30, 2003.
