  1.1                          A bill for an act 
  1.2             relating to traffic regulations; directing the 
  1.3             commissioner of transportation to conduct a pilot 
  1.4             project on trunk highway No. 169 and Pioneer trail to 
  1.5             collect photographic evidence and warn violators of 
  1.6             violations of traffic signal laws; requiring report to 
  1.7             the legislature. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [PILOT PROJECT; PHOTOGRAPHIC EVIDENCE OF 
  1.10  TRAFFIC VIOLATION.] 
  1.11     Subdivision 1.  [COMMISSIONER TO ESTABLISH PROJECT.] The 
  1.12  commissioner of transportation shall establish a pilot project 
  1.13  to test the feasibility and desirability of using photographic 
  1.14  evidence as a future basis for issuing citations for failure to 
  1.15  obey traffic signals. 
  1.16     Subd. 2.  [PHOTOGRAPHIC EQUIPMENT.] The commissioner shall 
  1.17  install, maintain, and operate automated photographic equipment, 
  1.18  not operated by a peace officer, at the intersection of marked 
  1.19  trunk highway No. 169 and Pioneer trail in Hennepin county, to 
  1.20  photograph motor vehicles operated in violation of Minnesota 
  1.21  Statutes, section 169.06, subdivision 4.  The photograph must 
  1.22  show, with sufficient clarity to identify, the vehicle and its 
  1.23  license plate, but not the occupants of the vehicle.  The 
  1.24  photograph must bear a printed record of the date, time of day, 
  1.25  and location of the violation. 
  1.26     Subd. 3.  [WARNING TICKETS.] If a photograph conforming 
  2.1   with the requirements in subdivision 2 shows a motor vehicle 
  2.2   that is operated in violation of Minnesota Statutes, section 
  2.3   169.06, subdivision 4, a warning ticket, together with the 
  2.4   photographic evidence, must be mailed to the registered owner or 
  2.5   lessee of the vehicle. 
  2.6      Subd. 4.  [LIMITATION OF USE OF PHOTOGRAPH.] Photographic 
  2.7   evidence obtained in connection with this pilot project may not 
  2.8   be used in any action, civil or criminal. 
  2.9      Subd. 5.  [REPORT.] The commissioner shall report to the 
  2.10  legislature by February 1, 2002, on the results of the pilot 
  2.11  program. 
  2.12     Sec.  2.  [EFFECTIVE DATE.] 
  2.13     Section 1 is effective July 1, 2000.
