A bill for an act
relating to public safety; providing that source codes for breath-testing
instruments are not admissible evidence; proposing coding for new law in
Minnesota Statutes, chapter 634.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

BREATH-TESTING INSTRUMENTS.

new text begin (a) As used in this section, an "infrared or other approved breath-testing instrument"
has the meaning given in section 169A.03, subdivision 11.

new text begin (b) The source code for an infrared or other approved breath-testing instrument is
not admissible into evidence in a civil or criminal hearing or trial.

new text begin (c) This section does not affect the admissibility into evidence of the results of
breath tests from infrared or other approved breath-testing instruments as required by
section 634.16.
