A bill for an act
 relating to environment; prohibiting unproductive conservation lands from being
considered benefited property under state drainage laws; proposing coding for new
law in Minnesota Statutes, chapter 103E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [103E.026] UNPRODUCTIVE CONSERVATION LANDS ARE NOT
BENEFITED BY DRAINAGE PROJECTS OR REPAIRS.

new text begin Notwithstanding any provision of this chapter to the contrary, any determination of
benefits under this chapter, whether for a drainage project or for repairing a drainage system,
must not include a determination that property is benefited if the property is subject to a
conservation easement.
