A bill for an act
relating to energy; requiring any person selling three or more fuel octane grades
to replace the middle grade with E85; amending Minnesota Statutes 2004,
section 239.751, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 239.751, is amended by adding a
subdivision to read:

new text begin By December 31, 2010, any person selling or
offering for sale gasoline or gasoline-oxygenate blends at retail and offering three or more
octane grades must replace one grade in all applicable dispensers with E85, as defined in
section 239.761, subdivision 13. The grade replaced by E85 must be a grade between the
highest octane fuel and the lowest octane fuel sold or offered for sale.
