  1.1                          A bill for an act 
  1.2             relating to human services; authorizing employment 
  1.3             bonuses for certain providers of personal care 
  1.4             assistant services; amending Minnesota Statutes 1998, 
  1.5             section 256B.0627, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 256B.0627, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 10a.  [PERSONAL CARE ASSISTANT BONUSES.] (a) The 
  1.10  commissioner shall pay an employment bonus to a personal care 
  1.11  assistant when the conditions in this subdivision are satisfied. 
  1.12     (b) A recipient of personal care assistant services may 
  1.13  apply to the commissioner for authorization to pay an employment 
  1.14  bonus to a personal care assistant.  In order to qualify to 
  1.15  offer a bonus, a recipient must have been unable to use at least 
  1.16  ten percent of the recipient's authorized personal care 
  1.17  assistant hours during the 12 months prior to the application, 
  1.18  due to the unavailability of personal care assistants to perform 
  1.19  authorized services. 
  1.20     (c) The bonus shall be equal to the dollar value of the 
  1.21  recipient's authorized but unused personal care assistant hours 
  1.22  during the prior 12 months, up to a maximum bonus of $2,500.  
  1.23  The commissioner shall inform the recipient within ten working 
  1.24  days of receipt of the request regarding: 
  1.25     (1) whether the recipient qualifies to offer a bonus; and 
  2.1      (2) if so, the value of the bonus the recipient may offer. 
  2.2      (d) A bonus shall be paid to the personal care assistant in 
  2.3   equal installments over a six-month period, provided the 
  2.4   assistant continues to perform all scheduled personal care 
  2.5   assistant services to the recipient during that period. 
  2.6      (e) A person is not eligible to receive a bonus if that 
  2.7   person has provided personal care assistant services in 
  2.8   Minnesota during the three months prior to the date the 
  2.9   recipient receives authorization from the commissioner to offer 
  2.10  the bonus.
