A bill for an act
relating to criminal justice; addressing the recording or broadcasting of certain
criminal proceedings; providing criminal penalties; proposing coding for new
law in Minnesota Statutes, chapter 631.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Except as otherwise
provided in this subdivision, no person may record or broadcast any criminal matter,
including a trial, hearing, motion, or argument, absent the express consent of the defendant,
the victim, the prosecutor, and any witness under subpoena or other compulsory process,
and the permission of the presiding judge. This prohibition applies to the use of television,
radio, audio, photographic, or other recording equipment. This prohibition does not apply
to the use of electronic, photographic, or other recording equipment approved by the court
for purposes of making the court record, including closed-circuit interactive television.

Any person who records or broadcasts a proceeding in violation
of subdivision 1 is guilty of a petty misdemeanor.

This section is effective August 1, 2017, and applies to
proceedings occurring on or after that date.
