A bill for an act
relating to retirement; public employees police and fire plan; permitting retired
members to return to work; proposing coding for new law in Minnesota Statutes,
chapter 353.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding
any state law to the contrary, including section 353.37, a person who is receiving an annuity
from the police and fire plan may return to employment with a governmental subdivision
without any reduction or suspension of the member's annuity if:

(1) the person has been separated from public service for at least 30 days; and

new text begin
(2) the person is returning to a position that is covered by the police and fire plan or the
state patrol plan administered by the Minnesota State Retirement System.

This section expires on December 31, 2032, and
the provisions of section 353.37 apply to any person reemployed under this section.

This section is effective the day following final enactment.
