  1.1                          A bill for an act 
  1.2             relating to natural resources; increasing the flood 
  1.3             hazard grant level for flood hazard mitigation 
  1.4             projects in the Red river basin that are subject to a 
  1.5             mediation agreement; providing funding for flood 
  1.6             hazard mitigation; authorizing state bonds; 
  1.7             appropriating money; amending Minnesota Statutes 1998, 
  1.8             section 103F.161, subdivision 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 103F.161, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [ACTION ON GRANT APPLICATIONS.] (a) A local 
  1.13  government may apply to the commissioner for a grant on forms 
  1.14  provided by the commissioner.  The commissioner shall confer 
  1.15  with the local government requesting the grant and may make a 
  1.16  grant up to $150,000 based on the following considerations: 
  1.17     (1) the extent and effectiveness of mitigation measures 
  1.18  already implemented by the local government requesting the 
  1.19  grant; 
  1.20     (2) the feasibility, practicality, and effectiveness of the 
  1.21  proposed mitigation measures and the associated nonflood related 
  1.22  benefits and detriments; 
  1.23     (3) the level of grant assistance that should be provided 
  1.24  to the local government, based on available facts regarding the 
  1.25  nature, extent, and severity of flood problems; 
  1.26     (4) the frequency of occurrence of severe flooding that has 
  1.27  resulted in declaration of the area as a flood disaster area by 
  2.1   the President of the United States; 
  2.2      (5) the economic, social, and environmental benefits and 
  2.3   detriments of the proposed mitigation measures; 
  2.4      (6) whether the floodplain management ordinance or 
  2.5   regulation adopted by the local government meets the minimum 
  2.6   standards established by the commissioner, the degree of 
  2.7   enforcement of the ordinance or regulation, and whether the 
  2.8   local government is complying with the ordinance or regulation; 
  2.9      (7) the degree to which the grant request is consistent 
  2.10  with local water plans developed under chapters 103B and 103D; 
  2.11     (8) the financial capability of the local government to 
  2.12  solve its flood hazard problems without financial assistance; 
  2.13  and 
  2.14     (9) the estimated cost and method of financing of the 
  2.15  proposed mitigation measures based on local money and federal 
  2.16  and state financial assistance. 
  2.17     (b) If the amount of the grant requested is $150,000 or 
  2.18  more, the commissioner shall determine, under the considerations 
  2.19  in paragraph (a), whether any part of the grant should be 
  2.20  awarded.  The commissioner must submit an appropriation request 
  2.21  to the governor and the legislature for funding consideration 
  2.22  before each odd-numbered year, consisting of requests or parts 
  2.23  of grant requests of $150,000 or more.  The commissioner must 
  2.24  prioritize the grant requests, under the considerations in 
  2.25  paragraph (a), beginning with the projects the commissioner 
  2.26  determines most deserving of financing. 
  2.27     (c) Except as provided in paragraph (e), a grant may not 
  2.28  exceed one-half the total cost of the proposed mitigation 
  2.29  measures. 
  2.30     (d) After July 1, 1991, grants made under this section may 
  2.31  be made to local governments whose grant requests are part of, 
  2.32  or responsive to, a comprehensive local water plan prepared 
  2.33  under chapter 103B or 103D. 
  2.34     (e) A grant for implementation of a flood hazard mitigation 
  2.35  project in the Red river basin that is consistent with a 
  2.36  mediation agreement and approved by the Red river flood damage 
  3.1   reduction work group may not exceed 75 percent of the cost of 
  3.2   the proposed mitigation measures. 
  3.3      Sec. 2.  [FLOOD HAZARD MITIGATION; APPROPRIATION.] 
  3.4      Subdivision 1.  [APPROPRIATION.] $13,300,000 is 
  3.5   appropriated from the bond proceeds fund to the commissioner of 
  3.6   natural resources for flood hazard mitigation grants under 
  3.7   Minnesota Statutes, section 103F.161.  $6,900,000 is for 
  3.8   implementation of projects consistent with the Red river basin 
  3.9   mediation agreement that are approved by the Red river flood 
  3.10  damage reduction work group. 
  3.11     Subd. 2.  [BOND SALE.] To provide the money appropriated in 
  3.12  this act from the bond proceeds fund, the commissioner of 
  3.13  finance shall sell and issue bonds of the state in an amount up 
  3.14  to $13,300,000 in the manner, upon the terms, and with the 
  3.15  effect prescribed by Minnesota Statutes, sections 16A.631 to 
  3.16  16A.675, and by the Minnesota Constitution, article XI, sections 
  3.17  4 to 7. 
  3.18     Sec. 3.  [EFFECTIVE DATE.] 
  3.19     Section 1 is effective the day following final enactment.
