1.1 A bill for an act 1.2 relating to courts; modifying provisions dealing with 1.3 appointment of chief judges; amending Minnesota 1.4 Statutes 1998, section 484.69, subdivision 1; 1.5 repealing Minnesota Statutes 1998, section 484.69, 1.6 subdivision 1a. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1998, section 484.69, 1.9 subdivision 1, is amended to read: 1.10 Subdivision 1. [ELECTIONAPPOINTMENT; TERM; REMOVAL.] For 1.11 each judicial district, the chief justice of the supreme court, 1.12 in consultation with the judges of the district courtresident1.13in eachand district court administrator of the judicial 1.14districts shall meet and elect from among their numberdistrict 1.15 for which an appointment is being made, shall appoint a single 1.16 chief judge and an assistant chief judge. The chief judge and 1.17 the assistant chief judge shall serve a term oftwofive years 1.18 beginning July 1 of the year in which they are elected.NoA 1.19 judge may serve as chief judge or assistant chief judge formore1.20than two consecutive two year terms, except as provided in1.21subdivision 1a. For the term beginning July 1, 1991, and after1.22that, the chief judge and assistant chief judge in the1.23odd-numbered judicial district shall be elected to a term of two1.24years. For the term beginning July 1, 1991, the chief judge and1.25assistant chief judge in the even-numbered judicial districts1.26shall be elected to a term of one year. For the term beginning2.1July 1, 1992, and after that, the chief judge and assistant2.2chief judge in the even-numbered judicial districts shall be2.3elected to a term of two yearsadditional terms if the incumbent 2.4 judge and the chief justice agree to the reappointment. 2.5 The seniority of judges and rotation of the position of 2.6 chief judge or assistant chief judge shall not be criteria for 2.7 the election of the chief judge or the assistant chief judge. 2.8 A chief judge or assistant chief judge may be removed for 2.9 cause as chief judge or assistant chief judge by the chief 2.10 justice of the supreme court,or by a majority ofin 2.11 consultation with the judges of the judicial district and the 2.12 district court administrator. 2.13 Sec. 2. [REPEALER.] 2.14 Minnesota Statutes 1998, section 484.69, subdivision 1a, is 2.15 repealed. 2.16 Sec. 3. [EFFECTIVE DATE; APPLICATION.] 2.17 Section 1 is effective August 1, 2000, for appointments to 2.18 terms expiring on or after that date.
