  1.1                          A bill for an act 
  1.2             relating to education finance; expanding the 
  1.3             alternative facilities levy program; amending 
  1.4             Minnesota Statutes 2000, section 123B.59, subdivision 
  1.5             5.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 123B.59, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [LEVY AUTHORIZED.] A district, after local board 
  1.10  approval, may levy for costs related to an approved facility 
  1.11  plan as follows:  
  1.12     (a) if the district has indicated to the commissioner that 
  1.13  bonds will be issued, the district may levy for the principal 
  1.14  and interest payments on outstanding bonds issued according to 
  1.15  subdivision 3 after reduction for any alternative facilities aid 
  1.16  receivable under subdivision 6; or 
  1.17     (b) if the district has indicated to the commissioner that 
  1.18  the plan will be funded through levy, the district may levy 
  1.19  according to the schedule approved in the plan after reduction 
  1.20  for any alternative facilities aid receivable under subdivision 
  1.21  6; or 
  1.22     (c) if the district has as a part of an approved plan, 
  1.23  found that the total cost of renovation of an individual school 
  1.24  site project exceeds 80 percent of the cost of new construction, 
  1.25  the school district may apply to the department of children, 
  2.1   families, and learning for a project specific exemption to allow 
  2.2   for use of this levy authority for new construction, due to cost 
  2.3   efficiencies.  No district is eligible for alternative 
  2.4   facilities aid under this paragraph.
