  1.1                          A bill for an act 
  1.2             relating to insurance; regulating public adjusters; 
  1.3             amending Minnesota Statutes 2000, section 72B.14. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  Minnesota Statutes 2000, section 72B.14, is 
  1.6   amended to read: 
  1.7      72B.14 [VIOLATIONS.] 
  1.8      A person who violates sections 72B.01 to 72B.14, or the 
  1.9   terms of any license or permit under sections 72B.01 to 72B.14, 
  1.10  or any lawful order of the commissioner in accordance with 
  1.11  sections 72B.01 to 72B.14, shall be subject to a fine imposed by 
  1.12  the commissioner, not in excess of $500, which may be imposed in 
  1.13  addition to the penalties prescribed in the provisions dealing 
  1.14  with the suspension or revocation of licenses or permits.  An 
  1.15  individual acting as an appraiser, adjuster, or adjuster's 
  1.16  solicitor who violates the law, or the adjuster or appraisal 
  1.17  organization that employs the individual or engages the 
  1.18  individual's services, is liable for all fines imposed under 
  1.19  sections 72B.01 to 72B.14 for the violations.  The commissioner 
  1.20  may assess those penalties against the insurance company that 
  1.21  engaged the adjusting or appraisal services, and in that event, 
  1.22  notice of the perceived infraction and the proposed penalty and 
  1.23  an opportunity to appeal must be given to the insurance company, 
  1.24  the adjuster or appraisal organization, and the individual.  If 
  2.1   a penalty is assessed against it, the insurance company may 
  2.2   collect the amount of those penalties from the organization or 
  2.3   individual.
