A bill for an act
relating to energy; requiring advance notice to certain local units of government
of intent to file certificate of need for construction of large energy facility;
amending Minnesota Statutes 2006, section 216B.243, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 216B.243, is amended by adding a
subdivision to read:

new text begin (a) A person intending to file an application for
a certificate of need for a pipeline or a high-voltage transmission line under this section
shall file, at least 180 days in advance of filing the application, a notice of intent to file the
application with each local unit of government that has jurisdiction within the proposed
facility's potential routing path.

new text begin (b) A public meeting with the applicant must be held within 30 days of a request by
any local unit of government served with a notice of intent to file. A single public meeting
attended by the applicant and representatives of all local units of government that request
a public meeting satisfies this requirement.

new text begin (c) A construction moratorium adopted by a local unit of government after receiving
notice under paragraph (a) does not apply to the proposed facility for which notice has
been provided.
