A bill for an act
relating to transportation; amending trunk highway project bidding procedures;
requiring use of alternative bidding for competing paving materials; amending
Minnesota Statutes 2008, section 161.32, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 161.32, is amended by adding a
subdivision to read:

new text begin (a) For purposes of this
subdivision, "applicable project" means a trunk highway project that is categorized in
the statewide transportation improvement program as for construction, reconstruction,
resurfacing, or reconditioning.

new text begin (b) On all contracts for an applicable project, the commissioner shall use alternative
bidding in which bidders may select between alternative project designs that use
competing paving materials.
