  1.1                          A bill for an act 
  1.2             relating to transportation; authorizing spending to 
  1.3             acquire and to better public land and buildings and 
  1.4             other public improvements of a capital nature with 
  1.5             certain conditions; authorizing issuance of bonds; 
  1.6             appropriating money. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8   Section 1.  [TRANSPORTATION; APPROPRIATIONS.] 
  1.9      The sums in the column under "APPROPRIATIONS" are 
  1.10  appropriated from the bond proceeds fund, or another named fund, 
  1.11  to the state agencies or officials indicated, to be spent to 
  1.12  acquire and to better public land and buildings and other public 
  1.13  improvements of a capital nature, as specified in this act.

  1.20  Sec. 2.  DEPARTMENT OF TRANSPORTATION 
  1.21  Subdivision 1.  To the
  1.22  commissioner of transportation for
  1.23  the purposes specified in this section              280,429,000
  1.24  Subd. 2.  Transitways                                56,000,000 
  1.25  This appropriation is from the state 
  1.26  transportation fund to match federal 
  1.27  and local funding for the planning, 
  1.28  design, engineering, and construction 
  1.29  of transitways in the metropolitan 
  2.1   area.  Of this amount, $50,000,000 is 
  2.2   for the preliminary engineering, final 
  2.3   design, and construction of light rail 
  2.4   transit in the Hiawatha Avenue corridor 
  2.5   from downtown Minneapolis through 
  2.6   Minneapolis-St. Paul International 
  2.7   Airport and the site of the former Met 
  2.8   Center or surrounding area with a 
  2.9   terminus in southern Hennepin or 
  2.10  northern Dakota county.  The remaining 
  2.11  funds must be distributed as grants to 
  2.12  appropriate county regional rail 
  2.13  authorities as follows: 
  2.14  (1) $3,000,000 to match federal funding 
  2.15  for a major investment study, 
  2.16  engineering, and implementation in the 
  2.17  Riverview corridor between the east 
  2.18  side of St. Paul and the 
  2.19  Minneapolis-St. Paul International 
  2.20  Airport and the Mall of America; 
  2.21  (2) $1,500,000 to match federal funding 
  2.22  for a major investment study, 
  2.23  engineering, and implementation in the 
  2.24  Northstar corridor linking downtown 
  2.25  Minneapolis to the St. Cloud area; 
  2.26  (3) $500,000 to study potential transit 
  2.27  improvements and engineering studies in 
  2.28  the Cedar Avenue corridor to link the 
  2.29  Hiawatha, Riverview, and Northstar 
  2.30  transit corridors with Dakota county; 
  2.31  (4) $500,000 to develop engineering 
  2.32  documents for the Northwest corridor 
  2.33  commuter rail line from downtown 
  2.34  Minneapolis to the Northwest suburbs of 
  2.35  Hennepin county; and 
  2.36  (5) $500,000 to develop engineering 
  2.37  documents for a commuter rail line from 
  2.38  downtown St. Paul through southern 
  2.39  Washington county to Hastings. 
  2.40  The Hiawatha Avenue corridor management 
  2.41  committee created pursuant to Minnesota 
  2.42  Statutes, section 473.3994, subdivision 
  2.43  10, shall establish an advisory 
  2.44  committee of: 
  2.45  (1) individuals who reside near the 
  2.46  proposed corridor; 
  2.47  (2) representatives of businesses 
  2.48  located within one mile on either side 
  2.49  of the corridor; and 
  2.50  (3) elected officials, including 
  2.51  legislators, who represent the area in 
  2.52  which the Hiawatha corridor is 
  2.53  located.  The advisory committee shall 
  2.54  advise the corridor management 
  2.55  committee on issues relating to the 
  2.56  preliminary engineering, final design, 
  2.57  and construction of light rail 
  2.58  facilities, including the proposed 
  2.59  alignment for the corridor. 
  2.60  The city of Bloomington is not required 
  2.61  to contribute from any funding source 
  3.1   under its control to the construction 
  3.2   of light rail transit facilities in the 
  3.3   Hiawatha corridor unless the city 
  3.4   voluntarily agrees to do so. 
  3.5   Subd. 3.  Local Bridge
  3.6   Replacement and Rehabilitation                       34,000,000
  3.7   This appropriation is from the state 
  3.8   transportation fund as provided in 
  3.9   Minnesota Statutes, section 174.50, to 
  3.10  match federal funds and to replace or 
  3.11  rehabilitate local deficient bridges. 
  3.12  Political subdivisions may use grants 
  3.13  made under this section to construct or 
  3.14  reconstruct bridges, including: 
  3.15  (1) matching federal-aid grants to 
  3.16  construct or reconstruct key bridges; 
  3.17  (2) paying the costs of preliminary 
  3.18  engineering and environmental studies 
  3.19  authorized under Minnesota Statutes, 
  3.20  section 174.50, subdivision 6a; 
  3.21  (3) paying the costs to abandon an 
  3.22  existing bridge that is deficient and 
  3.23  in need of replacement, but where no 
  3.24  replacement will be made; and 
  3.25  (4) paying the costs to construct a 
  3.26  road or street to facilitate the 
  3.27  abandonment of an existing bridge 
  3.28  determined by the commissioner to be 
  3.29  deficient, if the commissioner 
  3.30  determines that construction of the 
  3.31  road or street is more cost efficient 
  3.32  than the replacement of the existing 
  3.33  bridge. 
  3.34  Political subdivisions must match state 
  3.35  grants on at least an equal basis. 
  3.36  Subd. 4.  Port Development Grants                     6,000,000 
  3.37  This appropriation is from the state 
  3.38  transportation fund for port 
  3.39  development assistance grants.  The 
  3.40  grants must be made to political 
  3.41  subdivisions for capital improvements 
  3.42  under the provisions of Minnesota 
  3.43  Statutes, sections 457A.01 to 457A.06.  
  3.44  Any improvements made with the proceeds 
  3.45  of these grants must be publicly owned. 
  3.46  Subd. 5.  St. Cloud Headquarters                      9,429,000 
  3.47  This appropriation is from the trunk 
  3.48  highway fund for design, construction, 
  3.49  and furnishing of an addition and 
  3.50  remodeling of existing space at the 
  3.51  headquarters facility in St. Cloud. 
  3.52  Subd. 6.  Trunk Highway Bridges                     175,000,000 
  3.53  This appropriation is from the bridge 
  3.54  construction account in the trunk 
  3.55  highway fund created in section 9, 
  3.56  subdivision 2.  This appropriation is 
  3.57  for the reconstruction and replacement 
  4.1   of key bridges on the state trunk 
  4.2   highway system. 
  4.3   Sec. 3.  PUBLIC SAFETY                                1,328,000 
  4.4   To the commissioner of transportation 
  4.5   to design, construct, furnish, and 
  4.6   equip a state patrol training facility 
  4.7   at Camp Ripley in Little Falls.  This 
  4.8   appropriation is from the trunk highway 
  4.9   fund. 
  4.10  Sec. 4.  METROPOLITAN COUNCIL                        21,000,000 
  4.11  Subdivision 1.  To the
  4.12  metropolitan council for 
  4.13  the purposes specified in this section                         
  4.14  Subd. 2.  Snelling Bus Garage
  4.15  Replacement                                          12,000,000
  4.16  This appropriation is from the state 
  4.17  transportation fund to build a transit 
  4.18  garage in the east metropolitan area to 
  4.19  replace the existing Snelling Avenue 
  4.20  bus facility. 
  4.21  The metropolitan council shall consider 
  4.22  incorporating in a new transit garage a 
  4.23  child care facility to assist in the 
  4.24  recruitment and retention of 
  4.25  metropolitan transit drivers. 
  4.26  Subd. 3.  Metro Transit Radio
  4.27  Communications                                        4,500,000
  4.28  This appropriation is from the state 
  4.29  transportation fund to upgrade the 
  4.30  council's transit communications and 
  4.31  control facility. 
  4.32  Subd. 4.  Central Corridor                            4,500,000 
  4.33  This appropriation is from the state 
  4.34  transportation fund for matching 
  4.35  available federal funds for 
  4.36  improvements on the I-94 central 
  4.37  corridor. 
  4.38  Sec. 5.  FOREST HIGHWAY 11                            2,500,000 
  4.39  This appropriation is to the 
  4.40  commissioner of transportation from the 
  4.41  state transportation fund to fund the 
  4.42  nonfederal matching requirement for 
  4.43  Forest Highway 11 in St. Louis and Lake 
  4.44  counties. 
  4.45  Sec. 6.  DULUTH BUS BARN                                775,000 
  4.46  This appropriation is to the 
  4.47  commissioner of transportation from the 
  4.48  state transportation fund for a grant 
  4.49  to the Duluth Transit Authority for 
  4.50  facility restoration of the Earl C. 
  4.51  Buck Operating Center in Duluth. 
  4.52  Sec. 7.  TRANSIT VEHICLES                             3,000,000 
  4.53  This appropriation is to the 
  4.54  commissioner of transportation from the 
  5.1   general fund for transit vehicle 
  5.2   replacement for public transit systems 
  5.3   receiving operating assistance from the 
  5.4   commissioner under Minnesota Statutes, 
  5.5   section 174.24. 
  5.6   Sec. 8.  SEAWAY PORT AUTHORITY WAREHOUSE              4,200,000 
  5.7   This appropriation is to the 
  5.8   commissioner of transportation from the 
  5.9   state transportation fund for a grant 
  5.10  to the Seaway Port Authority of Duluth 
  5.11  for construction of a new warehouse. 
  5.12     Sec. 9.  [BOND SALE AUTHORIZATIONS.] 
  5.13     Subdivision 1.  [TRANSPORTATION FUND.] To provide the money 
  5.14  appropriated in this act from the state transportation fund, the 
  5.15  commissioner of finance, on request of the governor, shall sell 
  5.16  and issue general obligation bonds of the state in an amount up 
  5.17  to $124,475,000 in the manner, upon the terms, and with the 
  5.18  effect prescribed by Minnesota Statutes, sections 16A.631 to 
  5.19  16A.675, and by the Minnesota Constitution, article XI, sections 
  5.20  4 to 7.  The proceeds of the bonds, except accrued interest and 
  5.21  any premium received on the sale of the bonds, must be credited 
  5.22  to a bond proceeds account in the state transportation fund. 
  5.23     Subd. 2.  [TRUNK HIGHWAY BONDS.] The commissioner of 
  5.24  finance shall, on recommendation of the commissioner of 
  5.25  transportation, issue and sell Minnesota trunk highway bonds 
  5.26  under Minnesota Statutes, sections 167.50 to 167.52, and the 
  5.27  Minnesota Constitution, article XI, sections 4 to 7, and article 
  5.28  XIV, section 11, at such times and in such amounts as are 
  5.29  determined by the commissioner of transportation.  Bonds issued 
  5.30  under this section are authorized in an aggregate principal 
  5.31  amount of $175,000,000.  Not more than $35,000,000 of the bonds 
  5.32  authorized under this section may be sold in any fiscal year.  
  5.33  The proceeds from the bonds must be deposited in a separate 
  5.34  bridge construction account in the trunk highway fund. 
  5.35     Sec. 10.  [EFFECTIVE DATE.] 
  5.36     This act is effective the day following final enactment.
