  1.1                          A bill for an act
  1.2             relating to crime prevention; expanding the authority 
  1.3             of the commissioner of natural resources to support 
  1.4             search and rescue operations; requiring the 
  1.5             development of criteria regarding search and rescue 
  1.6             operations; amending Minnesota Statutes 1998, section 
  1.7             88.12, subdivision 2; Laws 1999, chapter 231, section 
  1.8             5, subdivision 4. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 88.12, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [CONTRACTS FOR SERVICES FOR FORESTRY OR WILDFIRE 
  1.13  PREVENTION WORK; COMMISSIONS TO PERSONS EMPLOYED.] The 
  1.14  commissioner is hereby authorized and empowered to contract for 
  1.15  or accept the services of any and all persons whose aid is 
  1.16  available, temporarily or otherwise, in forestry or wildfire 
  1.17  prevention work, either gratuitously or for compensation not in 
  1.18  excess of the limits provided by law with respect to the 
  1.19  employment of labor by the commissioner.  At the request of 
  1.20  another emergency response agency, trained forestry wildfire 
  1.21  fighting resources may be used to support search and rescue 
  1.22  operations.  The commissioner may issue a commission, or other 
  1.23  written evidence of authority, to any such person whose services 
  1.24  are so arranged for; and may thereby empower such person to act, 
  1.25  temporarily or otherwise, as fire warden, or in any other 
  1.26  capacity, with such powers and duties as may be specified in the 
  1.27  commission or other written evidence of authority, but not in 
  2.1   excess of the powers conferred by law on forest officers.  
  2.2      Sec. 2.  Laws 1999, chapter 231, section 5, subdivision 4, 
  2.3   is amended to read:

  2.11  presuppression and suppression costs of 
  2.12  emergency fire fighting and other costs 
  2.13  incurred under Minnesota Statutes, 
  2.14  section 88.12, subdivision 2, related 
  2.15  to search and rescue operations.  If 
  2.16  the appropriation for either year is 
  2.17  insufficient to cover all costs of 
  2.18  suppression and search and rescue 
  2.19  operations, the amount necessary to pay 
  2.20  for emergency firefighting these 
  2.21  expenses during the biennium is 
  2.22  appropriated from the general fund.  If 
  2.23  money is spent under the appropriation 
  2.24  in the preceding sentence, the 
  2.25  commissioner of natural resources 
  2.26  shall, by 15 days after the end of the 
  2.27  following quarter, report on how the 
  2.28  money was spent to the chairs of the 
  2.29  house of representatives ways and means 
  2.30  committee, the environment and 
  2.31  agriculture budget division of the 
  2.32  senate environment and natural 
  2.33  resources committee, and the house of 
  2.34  representatives environment and natural 
  2.35  resources finance committee.  The 
  2.36  appropriations may not be transferred.  
  2.37  $722,000 the first year and $724,000 
  2.38  the second year are for programs and 
  2.39  practices on state, county, and private 
  2.40  lands to regenerate and protect 
  2.41  Minnesota's white pine.  Up to $280,000 
  2.42  of the appropriation in each year may 
  2.43  be used by the commissioner to provide 
  2.44  50 percent matching funds to implement 
  2.45  cultural practices for white pine 
  2.46  management on nonindustrial, private 
  2.47  forest lands at rates specified in the 
  2.48  Minnesota stewardship incentives 
  2.49  program manual.  Up to $150,000 of the 
  2.50  appropriation in each year may be used 
  2.51  by the commissioner to provide funds to 
  2.52  implement cultural practices for white 
  2.53  pine management on county-administered 
  2.54  lands through grant agreements with 
  2.55  individual counties, with priorities 
  2.56  for areas that experienced wind damage 
  2.57  in July 1995.  $40,000 each year is for 
  2.58  a study of the natural regeneration 
  2.59  process of white pine.  The remainder 
  2.60  of the funds in each fiscal year will 
  2.61  be available to the commissioner for 
  2.62  white pine regeneration and protection 
  3.1   on department-administered lands. 
  3.2   The commissioner may contract with and 
  3.3   make grants to nonprofit agencies to 
  3.4   carry out the purposes, plans, and 
  3.5   programs of the office of youth 
  3.6   programs, Minnesota conservation corps. 
  3.7   $61,000 the first year and $62,000 the 
  3.8   second year are for the focus on 
  3.9   community forests program, to provide 
  3.10  communities with natural resources 
  3.11  technical assistance. 
  3.12  $225,000 the first year is for grants 
  3.13  to local community forest ecosystem 
  3.14  health programs.  This appropriation is 
  3.15  available until June 30, 2001.  The 
  3.16  commissioner of natural resources shall 
  3.17  allocate individual grants of up to 
  3.18  $25,000 to local communities that match 
  3.19  the grants with nonstate money to 
  3.20  undertake projects that improve the 
  3.21  health of forest ecosystems, including 
  3.22  insect and disease suppression 
  3.23  programs, community-based forest health 
  3.24  education programs, and other 
  3.25  arboricultural treatments. 
  3.26  $100,000 the first year and $100,000 
  3.27  the second year are an increase in the 
  3.28  base appropriation for the Minnesota 
  3.29  conservation corps program activities.  
  3.30  $500,000 each year is for the 
  3.31  activities of the forest resources 
  3.32  council.  This is a one-time 
  3.33  appropriation. 
  3.34     Sec. 3.  [DEVELOPMENT OF SEARCH AND RESCUE OPERATIONS 
  3.35  CRITERIA.] 
  3.36     (a) By July 1, 2000, the superintendent of the bureau of 
  3.37  criminal apprehension and the commissioner of natural resources 
  3.38  shall develop criteria for determining the types of search and 
  3.39  rescue operations that may be supported under sections 1 and 2. 
  3.40     (b) By July 1, 2000, the superintendent and commissioner 
  3.41  shall report the criteria developed to the chairs and ranking 
  3.42  minority members of the senate and house committees and 
  3.43  divisions having jurisdiction over criminal justice and 
  3.44  environment and natural resources funding. 
  3.45     Sec. 4.  [EFFECTIVE DATES.] 
  3.46     Section 3 is effective the day following final enactment.  
  3.47  Sections 1 and 2 are effective July 1, 2000.
