A bill for an act
relating to public safety; prohibiting loitering near schools and places where
children congregate; proposing coding for new law in Minnesota Statutes,
chapter 609.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Except as provided in subdivision 2, a person who
loiters about or near any school or public place where children attend or normally
congregate after being asked to leave by an authorized person is guilty of a misdemeanor.

A person required to register as a predatory offender,
in this state or another jurisdiction, who loiters about or near any school or public place
where children attend or normally congregate after being asked to leave by an authorized
person is guilty of a gross misdemeanor.

(a) For the purposes of this section, the terms in this
subdivision have the meanings given them.

(b) "Loiter" means to delay, linger, or idle about without lawful business for being
present.

(c) "Authorized person" means a principal, a person designated by a principal to
provide school security, the chief administrative officer of a facility where children
normally congregate, or a licensed peace officer.

This section is effective August 1, 2008, and applies to
offenses committed on or after that date.
