  1.1                          A bill for an act 
  1.2             relating to education; providing for year-round 
  1.3             school; requiring guidelines for intersession staff 
  1.4             development and student remediation; amending 
  1.5             Minnesota Statutes 1996, section 121.585, by adding a 
  1.6             subdivision; Minnesota Statutes 1997 Supplement, 
  1.7             section 124A.22, subdivision 2. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 121.585, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 9.  [YEAR-ROUND SCHOOL.] (a) For the purposes of this 
  1.12  subdivision, "education site" means a separate facility.  A 
  1.13  program within a facility is an education site if the school 
  1.14  board recognizes it as a site. 
  1.15     (b) Notwithstanding section 124.17, subdivision 1, 
  1.16  paragraph (d), a kindergarten pupil enrolled at an elementary 
  1.17  school education site that establishes a year-round academic 
  1.18  calendar and provides all day kindergarten instruction, shall be 
  1.19  counted as 1.06 pupil units for fiscal year 1999 and thereafter. 
  1.20     (c) The department must adopt guidelines to set minimum 
  1.21  standards for staff development and student remediation during 
  1.22  intersessions.  The commissioner shall annually certify which 
  1.23  districts qualify for additional funding under these guidelines 
  1.24  no later than November 30 of each year. 
  1.25     (d) Each district that has one or more education sites that 
  1.26  qualifies for additional funding under section 124A.22, 
  2.1   subdivision 2, paragraph (b), must annually file a report with 
  2.2   the department no later than October 1, specifying how, for the 
  2.3   following school year, the year-round academic calendar of each 
  2.4   of its qualifying education sites meets the department 
  2.5   guidelines for intersession staff development and student 
  2.6   remediation, as well as a one-month summer vacation.  A district 
  2.7   that has more than one education site that qualifies under 
  2.8   section 124A.22, subdivision 2, paragraph (b), must coordinate 
  2.9   with all education sites adopting a year-round academic calendar 
  2.10  to ensure that intersessions and vacations occur on the same 
  2.11  calendar dates. 
  2.12     Sec. 2.  Minnesota Statutes 1997 Supplement, section 
  2.13  124A.22, subdivision 2, is amended to read: 
  2.14     Subd. 2.  [BASIC REVENUE.] (a) The basic revenue for each 
  2.15  district equals the formula allowance times the actual pupil 
  2.16  units for the school year.  The formula allowance for fiscal 
  2.17  year 1997 is $3,505.  The formula allowance for fiscal year 1998 
  2.18  is $3,581 and the formula allowance for fiscal year 1999 and 
  2.19  subsequent fiscal years is $3,530. 
  2.20     (b) The revenue for a district that operates a program 
  2.21  under section 121.585, subdivision 9, is increased by an amount 
  2.22  equal to $50 times the number of actual pupil units at the site 
  2.23  where the program is implemented.
