  1.1                          A bill for an act 
  1.2             relating to labor; interest arbitration; restricting 
  1.3             selection to final offer total packages; amending 
  1.4             Minnesota Statutes 1998, section 179A.16, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 179A.16, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 7b.  [DECISION AFFECTING STATE EMPLOYEES.] For state 
  1.10  employee bargaining units defined as essential under section 
  1.11  179A.03, subdivision 7, subdivision 7 governs, except that the 
  1.12  arbitrator or panel is restricted to selecting between the final 
  1.13  offer total packages of the parties as submitted to the 
  1.14  commissioner at impasse, unless conventional arbitration is 
  1.15  agreed to by both parties in writing.  However, the arbitrator 
  1.16  or panel has no jurisdiction or authority to entertain any 
  1.17  matter or issue that is not a term and condition of employment 
  1.18  or protected by section 179A.07, subdivision 1, unless the 
  1.19  matter or issue was included in the employer's final position.
