A bill for an act
relating to public safety; modifying the definition of sex trafficking and defining
commercial sex act; amending Minnesota Statutes 2008, section 609.321, by
adding a subdivision; Minnesota Statutes 2009 Supplement, section 609.321,
subdivision 7a.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2009 Supplement, section 609.321, subdivision 7a,
is amended to read:
"Sex trafficking" means:
(1) receiving, recruiting, enticing, harboring, providing, or obtaining by any means

(2) receiving profit or anything of value, knowing or having reason to know it is
derived from an act described in clause (1)new text begin ;

(3) inducing an individual through the use of force, fraud, or coercion to engage in
a commercial sex act; or

new text begin (4) inducing an individual who is under the age of 18 to engage in a commercial
sex actnew text end .

This section is effective August 1, 2010, and applies to crimes
committed on or after that date.

Minnesota Statutes 2008, section 609.321, is amended by adding a subdivision
to read:

A "commercial sex act" means a sex act on account
of which anything of value is given or received by any person.
