A bill for an act
relating to human services; creating an adoption advisory task force and requiring
a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin ADOPTION ADVISORY TASK FORCE.

new text begin Creation; membership. new text end

new text begin An adoption advisory task force is created
to study and make recommendations regarding content, reorganization, and recodification
of statutes and rules related to adoption. The task force is composed of 15 members
appointed by the commissioner of human services as follows:

new text begin (1) the commissioner of health, or the commissioner's designee;
new text end

new text begin (2) an attorney who practices adoption law;
new text end

new text begin (3) a representative from the Minnesota Supreme Court Adoption Rules Committee;
new text end

new text begin (4) a representative from three private social service agencies that perform adoptions;
new text end

new text begin (5) a private practitioner who provides postadoption search and reunification
services;
new text end

new text begin (6) a Department of Human Services staff member whose primary responsibility
is adoption and related services;
new text end

new text begin (7) a representative of a social service agency providing adoption services for
minority families;
new text end

new text begin (8) an enrolled tribal member with expertise in the Indian Child Welfare Act;
new text end

new text begin (9) two representatives of county social service agencies;
new text end

new text begin (10) an adoptive parent;
new text end

new text begin (11) an adopted person identified by an adoption advocacy group; and
new text end

new text begin (12) two birth parents identified by a birth parent advocacy group.

new text begin The commissioner of human services, or the commissioner's designee, shall chair
the task force.

new text begin Subd. 2. new text end

new text begin Expenses. new text end

new text begin Members shall not receive a per diem, but shall receive
reimbursement for expenses as provided in section 15.091, subdivision 6.

new text begin Duties; report. new text end

new text begin The task force shall meet on a regular basis to perform
the following duties:

new text begin (a) review and report on whether the existing adoption and birth record statutes and
rules need to be rewritten to reflect best practice guidelines as reported to the legislature
in 2006;

new text begin (b) review and report on whether existing adoption and birth record statutes and
rules need to be recodified; and
new text end

new text begin (c) propose legislation to implement statutory changes in content and reorganization
of adoption and birth record statutes. The task force shall submit a written report with its
findings and recommendations to the house and senate committees having jurisdiction
over adoption by January 10, 2007.
