A bill for an act
relating to health; amending membership of the Emergency Medical Services
Regulatory Board; amending Minnesota Statutes 2022, section 144E.01,
subdivisions 1, 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 144E.01, subdivision 1, is amended to read:


Subdivision 1.

Membership.

(a) The Emergency Medical Services Regulatory Board
consists of the following members, all of whom must work in Minnesota, except for the

(1) an emergency physician certified by the American Board of Emergency deleted text begin Physiciansdeleted text end new text begin

(b) The governor shall appoint members under paragraph (a). Appointments under

the senate. In making appointments under paragraph (a)deleted text begin , clauses (1) to (9) and (11) to (13)deleted text end ,
the governor shall consider recommendations of the American College of Emergency
Physicians, the Minnesota Hospital Association, the Minnesota and State Fire Chief's
Association, the Minnesota Ambulance Association, the Minnesota Emergency Medical
Services Association, deleted text begin the Minnesota State Sheriff's Association,deleted text end the Association of Minnesota
Counties, the Minnesota Nurses Association, and the deleted text begin Minnesota chapter of the Academy
of Pediatrics

Sec. 2.

Minnesota Statutes 2022, section 144E.01, subdivision 2, is amended to read:


Subd. 2.

Ex officio members.

The speaker of the house and the Committee on Rules
and Administration of the senate shall appoint one representative and one senator to serve
as ex officio, nonvoting members.new text begin The commissioners of health and public safety shall
appoint one state employee from their agencies to serve as ex officio, nonvoting members.
The Medical Director Standing Advisory Committee of the board shall designate a
pediatrician who shall serve as an ex officio member to advise the board on matters pertaining
to pediatric care.

Sec. 3. new text begin EMERGENCY MEDICAL SERVICES REGULATORY BOARD
MEMBERSHIP TRANSITION.

new text begin (a) Members serving on the Emergency Medical Services Regulatory Board on the
effective date of sections 1 and 2 that were appointed pursuant to Minnesota Statutes 2022,
section 144E.01, subdivision 1, paragraph (a), clauses (8) to (12), will serve until the
expiration of the member's term.

new text begin (b) Members serving on the Emergency Medical Services Regulatory Board on the
effective date of sections 1 and 2 that were appointed pursuant to Minnesota Statutes 2022,
section 144E.01, subdivision 1, paragraph (a), clauses (1) to (7), (13), and (14), will serve
until the expiration of the member's term and until a replacement member is appointed
consistent with the requirements of section 1.

new text begin (c) The members serving on the Emergency Medical Services Regulatory Board on the
effective date of this act that were appointed pursuant to Minnesota Statutes 2022, section
144E.01, subdivision 1, paragraph (a), clause (15), shall become ex officio members upon
the appointment of a second local government representative or 90 days after the date of
enactment, whichever is earlier.

Board as provided in section 1 may be appointed 30 days after final enactment.

new text begin (e) Upon the expiration of term of the pediatrician serving on the Emergency Medical
Services Regulatory Board on the effective date of sections 1 and 2 that was appointed
pursuant to Minnesota Statutes 2022, section 144E.01, subdivision 1, paragraph (a), clause
(12), the Medical Director Standing Advisory Committee of the board shall designate a
pediatrician who shall serve as an ex officio member as provided in section 2.

as provided in this section and section 1 must be completed no later than July 1, 2026.
