  1.1                          A bill for an act 
  1.2             relating to children and families; creating a state 
  1.3             prevention council; appropriating money for home 
  1.4             visiting programs; proposing coding for new law as 
  1.5             Minnesota Statutes, chapter 119C. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [119C.01] [ESTABLISHMENT.] 
  1.8      A 24-member state prevention council is established to 
  1.9   develop a unified state strategy to ensure that all young 
  1.10  children and their families in the state have access to 
  1.11  comprehensive high quality early childhood development and 
  1.12  family support services and resources. 
  1.13     Sec. 2.  [119C.02] [MEMBERSHIP.] 
  1.14     Subdivision 1.  [LEGISLATIVE APPOINTMENTS.] The senate 
  1.15  subcommittee on committees of the committee on rules and 
  1.16  administration shall appoint two members.  One of the members 
  1.17  appointed shall represent outstate Minnesota and the other 
  1.18  member appointed shall represent the seven-county metropolitan 
  1.19  area.  The speaker of the house of representatives shall appoint 
  1.20  two members.  One of the members appointed shall represent 
  1.21  outstate Minnesota and the other member appointed shall 
  1.22  represent the seven-county metropolitan area.  
  1.23     Subd. 2.  [COUNTY APPOINTMENTS.] The association of 
  1.24  Minnesota counties shall appoint four members.  Two members 
  1.25  shall represent outstate Minnesota and two members shall 
  2.1   represent the seven-county metropolitan area.  
  2.2      Subd. 3.  [PUBLIC APPOINTMENTS.] The governor shall appoint 
  2.3   eight public members who represent the interests of children and 
  2.4   families in need of preventive services.  
  2.5      Subd. 4.  [STATE AGENCY APPOINTMENTS.] Six members shall be 
  2.6   the commissioners of children, families, and learning; health; 
  2.7   human services; corrections; public safety; and economic 
  2.8   security, or their designees. 
  2.9      Subd. 5.  [ATTORNEY GENERAL.] The attorney general or a 
  2.10  designee shall be a member. 
  2.11     Subd. 6.  [SUPREME COURT.] The chief justice of the 
  2.12  Minnesota supreme court or a designee shall be a member.  
  2.13     Subd. 7.  [EQUAL REPRESENTATION.] The appointing 
  2.14  authorities under this section shall ensure that, to the extent 
  2.15  possible, the council members represent the interests of 
  2.16  children and families throughout Minnesota, including equal 
  2.17  representation between metropolitan and nonmetropolitan areas of 
  2.18  the state.  
  2.19     Subd. 8.  [TERMS; COMPENSATION; REMOVAL; 
  2.20  VACANCIES.] Section 15.059 shall govern the council except that 
  2.21  council members shall not receive per diem but shall receive 
  2.22  expense reimbursement as specified under section 15.059. 
  2.23     Subd. 9.  [ADMINISTRATION.] The commissioner of children, 
  2.24  families, and learning shall provide office space, equipment and 
  2.25  supplies, and technical assistance to the council. 
  2.26     Sec. 3.  [119C.03] [DUTIES.] 
  2.27     The prevention council shall: 
  2.28     (1) develop a long-term unified state prevention plan to 
  2.29  reduce child abuse and neglect, juvenile delinquency, substance 
  2.30  abuse, truancy, and other socially destructive behavior.  The 
  2.31  plan must focus on strengthening the commitments and capacity of 
  2.32  local communities to alter the conditions that contribute to 
  2.33  these behaviors; 
  2.34     (2) set the goals and objectives of the statewide 
  2.35  prevention plan by identifying measurable outcomes; 
  2.36     (3) develop proposals to integrate and build upon 
  3.1   successful prevention methods and programs; 
  3.2      (4) recommend consolidation, if needed, of existing 
  3.3   programs that involve families with young children; and 
  3.4      (5) make recommendations on a continuous funding source 
  3.5   that would provide long-range resources for the prevention of 
  3.6   child abuse and neglect with the ultimate goal of reducing 
  3.7   violence.  
  3.8      Sec. 4.  [119C.04] [REPORT.] 
  3.9      The council shall submit a statewide prevention plan and 
  3.10  recommendations by January 1, 2001, to the governor and 
  3.11  legislature.  The council shall biannually review and revise the 
  3.12  prevention plan and report to the governor and legislature by 
  3.13  January 1 of each odd-numbered year. 
  3.14     Sec. 5.  [APPROPRIATION.] 
  3.15     $49,500 is appropriated from the general fund to the 
  3.16  commissioner of children, families, and learning for fiscal year 
  3.17  2001 for purposes of section 2, subdivision 9.  The 
  3.18  appropriation is available until expended. 
  3.19     $1,050,000 is appropriated from the general fund to the 
  3.20  commissioner of health for home visiting programs for fiscal 
  3.21  year 2001.  Of this appropriation, $180,000 is to be used for 
  3.22  the targeted home visiting program described under Minnesota 
  3.23  Statutes, section 145A.15, and $870,000 is to be used for the 
  3.24  universally offered home visiting program described under 
  3.25  Minnesota Statutes, section 145A.16.  This appropriation shall 
  3.26  become part of the base appropriation.
