A bill for an act
relating to health; modifying definitions for lodging establishments; amending
Minnesota Statutes 2008, section 157.15, subdivision 8; repealing Minnesota
Statutes 2008, section 157.15, subdivisions 7, 11.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2008, section 157.15, subdivision 8, is amended to read:

residential or commercial new text end building, structure, enclosure, or any part thereof used as,
maintained as, new text begin ornew text end advertised deleted text begin as, or held out to be a placedeleted text end new text begin ,new text end where sleeping accommodations
are furnished to the public deleted text begin as regular roomers, for periods of one week or more, and
having five or more beds to let to the publicdeleted text end .new text begin A lodging establishment includes, but is
not limited to:

(1) a hotel, motel, or bed and breakfast where sleeping accommodations are
furnished to the public;

new text begin
(2) a resort which is located on, or on property neighboring, any lake, stream, skiing
or hunting area, or any recreational area for purposes of providing convenient access to
the public and a place where sleeping accommodations are furnished to the public and
primarily to the public seeking recreation; or

(3) any other residential or commercial building as described in subdivision 8a.

"Advertised" or "advertising" as used in this subdivision means print, broadcast, or
electronic communications.

(b) Lodging establishments do not include single-family homes or multifamily
housing units which contain individual kitchen and bath facilities that are rented or leased
for a continuous period of one month or more.

(c) A single-family home or a single-family cabin is exempt from this section when
furnished to the public two times or less per year unless advertising is used as defined
in this subdivision.
