  1.1             CONFERENCE COMMITTEE REPORT ON S.F. NO. 3133 
  1.2                          A bill for an act 
  1.3             relating to health; requiring legislative approval 
  1.4             before the commissioner of health adopts certain new 
  1.5             or amended rules governing the Minnesota Clean Indoor 
  1.6             Air Act; amending Minnesota Statutes 2000, section 
  1.7             144.417, subdivision 1.

  1.15     We, the undersigned conferees for S.F. No. 3133, report 
  1.16  that we have agreed upon the items in dispute and recommend as 
  1.17  follows: 
  1.18     
  1.19     That the House recede from its amendments and that S.F. No. 
  1.20  3133 be further amended as follows: 
  1.21     Delete everything after the enacting clause and insert: 
  1.22     "Section 1.  Minnesota Statutes 2000, section 144.417, 
  1.23  subdivision 1, is amended to read: 
  1.24     Subdivision 1.  [RULES.] (a) The state commissioner of 
  1.25  health shall adopt rules necessary and reasonable to implement 
  1.26  the provisions of sections 144.411 to 144.417, except as 
  1.27  provided for in section 144.414.  
  1.28     (b) Rules implementing sections 144.411 to 144.417 adopted 
  1.29  after January 1, 2002, may not take effect until approved by a 
  2.1   law enacted after January 1, 2002.  This paragraph does not 
  2.2   apply to a rule or severable portion of a rule governing smoking 
  2.3   in office buildings, factories, warehouses, or similar places of 
  2.4   work, or in health care facilities.  This paragraph does not 
  2.5   apply to a rule changing the definition of "restaurant" to make 
  2.6   it the same as the definition in section 157.15, subdivision 12. 
  2.7      [EFFECTIVE DATE.] This section is effective the day 
  2.8   following final enactment. 
  2.9      Sec. 2.  [LIMITED ENGLISH PROFICIENT STUDENTS; WRITTEN 
  2.10  COMPOSITION BASIC SKILLS TEST.] 
  2.11     A school district may offer to limited English proficient 
  2.12  students in their anticipated graduation year the additional 
  2.13  testing opportunity beyond the April retest date under Minnesota 
  2.14  Rules, part 3501.0250, for the 2002-2003 and 2003-2004 school 
  2.15  years only.  To be eligible for this additional testing 
  2.16  opportunity, the student must achieve a score of at least two on 
  2.17  the written composition basic skills test and meet all other 
  2.18  graduation requirements.  The district also must demonstrate, 
  2.19  consistent with Minnesota Rules, part 3501.0110, that the 
  2.20  limited English proficient student's remediation plan includes a 
  2.21  diagnostic analysis of the student's writing and shows that 
  2.22  educators intervened with the student, consistent with the 
  2.23  student's test results.  The district must offer the student 
  2.24  additional remediation before the May retesting date. 
  2.25     [EFFECTIVE DATE.] This section is effective the day 
  2.26  following final enactment." 
  2.27     Delete the title and insert: 
  2.28                         "A bill for an act 
  2.29            relating to administrative rules; requiring 
  2.30            legislative approval before certain new or amended 
  2.31            rules under the Clean Indoor Air Act are adopted; 
  2.32            authorizing school districts to offer additional 
  2.33            testing opportunities to limited English proficient 
  2.34            students; amending Minnesota Statutes 2000, section 
  2.35            144.417, subdivision 1. 
  3.1      We request adoption of this report and repassage of the 
  3.2   bill.
