  1.1                          A bill for an act 
  1.2             relating to natural resources; designating certain 
  1.3             wildlife management areas; adding land to certain 
  1.4             state forests; deleting land from certain wildlife 
  1.5             management areas; providing for all-terrain vehicle 
  1.6             use in certain wildlife management areas; providing 
  1.7             for certain exchanges; requiring a report; 
  1.8             appropriating money; amending Minnesota Statutes 1998, 
  1.9             sections 97A.135, subdivision 2a; and 477A.11, 
  1.10            subdivisions 3 and 4; proposing coding for new law in 
  1.11            Minnesota Statutes, chapter 97A. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  [LEGISLATIVE FINDINGS; PURPOSE.] 
  1.14     Consolidated-conservation lands are lands that have a 
  1.15  unique status under the legislative acts of 1929, 1931, and 1933 
  1.16  that created boundaries for the lands to become 
  1.17  consolidated-conservation lands in Beltrami, Koochiching, Lake 
  1.18  of the Woods, Aitkin, Mahnomen, Marshall, and Roseau counties.  
  1.19  The counties and the commissioner of natural resources have had 
  1.20  joint interests, responsibilities, and receipts of revenues from 
  1.21  the consolidated-conservation lands as provided by law which 
  1.22  have led to disagreements and frustration over the designation 
  1.23  and use of these lands.  The lands were privately owned and 
  1.24  became tax-forfeited from drainage and property taxes leaving 
  1.25  the counties with the burden of providing infrastructure without 
  1.26  taxable lands to provide supporting revenue.  The commissioner 
  1.27  of natural resources has been charged with developing game 
  1.28  preserves, forestry areas, and other state purposes on these 
  2.1   lands that were previously privately owned and drained wholly or 
  2.2   partially for settlement.  The goals and uses for the 
  2.3   consolidated-conservation lands require a working relationship 
  2.4   between the counties and the commissioner to resolve state and 
  2.5   county concerns for the lands. 
  2.6      It is the purpose of this act to designate certain 
  2.7   consolidated-conservation lands as forestry or wildlife 
  2.8   management lands with certain uses so that there is no further 
  2.9   dispute about the status of those lands, to provide increased 
  2.10  payments in lieu of taxes to support county infrastructure, and 
  2.11  to provide a structure and forum for the counties and the 
  2.12  commissioner to resolve identified issues and make common 
  2.13  recommendations to the legislature. 
  2.14     Sec. 2.  [97A.133] [STATE WILDLIFE MANAGEMENT AREAS.] 
  2.15     Subdivision 1.  [ESTABLISHMENT.] State wildlife management 
  2.16  areas are established and designated as provided under this 
  2.17  section.  State wildlife management areas are located and named 
  2.18  as indicated in this section. 
  2.19     Subd. 2.  [PAYMENT IN LIEU OF TAXES.] The consolidated 
  2.20  conservation lands included in state wildlife management areas 
  2.21  are subject to the payment in lieu tax as provided in section 
  2.22  477A.12, paragraph (a), clause (1). 
  2.23     Subd. 3.  [ALL-TERRAIN VEHICLE TRAVEL WITHIN DESIGNATED 
  2.24  WILDLIFE MANAGEMENT AREAS.] (a) On lands acquired by the state 
  2.25  under chapter 84A that are designated after January 1, 1986, as 
  2.26  wildlife management areas, the commissioner shall, by January 
  2.27  15, 2003, identify and designate corridor trails in corridors of 
  2.28  disturbance that the commissioner determines are appropriate to 
  2.29  connect trails, forest roads established under section 89.71, 
  2.30  subdivision 1, and public highways to provide reasonable travel 
  2.31  for all-terrain vehicles.  The commissioner shall consult with 
  2.32  wildlife management area users, including both motorized and 
  2.33  nonmotorized trail users, in identifying and designating 
  2.34  corridor trails under this paragraph.  Corridor trail 
  2.35  establishment must be in compliance with other state and federal 
  2.36  law.  Local governments and other trail sponsors may propose the 
  3.1   designation of corridor trails, including the designation as a 
  3.2   grant-in-aid trail for the purposes of funding under section 
  3.3   84.927, subdivision 2. 
  3.4      (b) The following forest roads shall be open to travel by 
  3.5   all-terrain vehicles when the roads are open to other 
  3.6   noncommercial vehicles: 
  3.7      (1) the Rapid River forest road, beginning at the west 
  3.8   boundary of the Red Lake wildlife management area at the 
  3.9   southwest corner of Section 7, Township 156 North, Range 35 
  3.10  West, Beltrami county, thence in an easterly and northeasterly 
  3.11  direction through the Red Lake wildlife management area to the 
  3.12  east boundary of the Red Lake wildlife management area at the 
  3.13  southwest corner of Section 7, Township 157 North, Range 33 
  3.14  West, Lake of the Woods county; 
  3.15     (2) the Blanchard forest road, beginning at the junction of 
  3.16  the North Shore Road along the northern shore of Upper Red Lake 
  3.17  and the Blanchard state forest road at the west section line of 
  3.18  Section 30, Township 155 North, Range 31 West, Beltrami county, 
  3.19  thence in a westerly direction to the west section line of 
  3.20  Section 31, Township 155 North, Range 32 West; and 
  3.21     (3) the Moose River forest road, beginning at the junction 
  3.22  of Dick's Parkway state forest road and the Moose River state 
  3.23  forest road at the southwest corner of Section 31, Township 36 
  3.24  West, Range 158 North, thence in a westerly direction along the 
  3.25  Moose River state forest road to the junction of Beltrami county 
  3.26  road 706. 
  3.27     (c) The commissioner shall sign each road and trail 
  3.28  designated under this subdivision indicating the motorized uses 
  3.29  allowed. 
  3.30     (d) For the purposes of this subdivision, "corridors of 
  3.31  disturbance" means rights-of-way such as ditches, ditch banks, 
  3.32  transmission lines, pipelines, permanent roads, winter roads, 
  3.33  and recreational trails.  The existence of a corridor of 
  3.34  disturbance eligible for corridor designation may be 
  3.35  demonstrated by physical evidence, document recorded in the 
  3.36  office of the county recorder or other public official, aerial 
  4.1   survey, or other evidence similar to the above.  Cross-country 
  4.2   motorized use of land shall not cause that land to be considered 
  4.3   a corridor of disturbance.

  6.31     Sec. 3.  Minnesota Statutes 1998, section 97A.135, 
  6.32  subdivision 2a, is amended to read: 
  6.33     Subd. 2a.  [DISPOSAL OF LAND IN WILDLIFE MANAGEMENT AREAS.] 
  6.34  (a) The commissioner may sell or exchange land in a wildlife 
  6.35  management area authorized by designation under section 86A.07, 
  6.36  subdivision 3, 97A.133, or 97A.145 if the commissioner vacates 
  7.1   the designation before the sale or exchange in accordance with 
  7.2   this subdivision.  The designation may be vacated only if the 
  7.3   commissioner finds, after a public hearing, that the disposal of 
  7.4   the land is in the public interest. 
  7.5      (b) A sale under this subdivision is subject to sections 
  7.6   94.09 to 94.16.  An exchange under this subdivision is subject 
  7.7   to sections 94.341 to 94.348. 
  7.8      (c) Revenue received from a sale authorized under paragraph 
  7.9   (a) is appropriated to the commissioner for acquisition of 
  7.10  replacement wildlife management lands. 
  7.11     (d) Land acquired by the commissioner under this 
  7.12  subdivision must meet the criteria in section 86A.05, 
  7.13  subdivision 8, and as soon as possible after the acquisition 
  7.14  must be designated as a wildlife management area under section 
  7.15  86A.07, subdivision 3, 97A.133, or 97A.145. 
  7.16     (e) In acquiring land under this subdivision, the 
  7.17  commissioner must give priority to land within the same 
  7.18  geographic region of the state as the land conveyed. 
  7.19     Sec. 4.  Minnesota Statutes 1998, section 477A.11, 
  7.20  subdivision 3, is amended to read: 
  7.21     Subd. 3.  [ACQUIRED NATURAL RESOURCES LAND.] "Acquired 
  7.22  natural resources land" means: 
  7.23     (1) any land presently administered by the commissioner in 
  7.24  which the state acquired by purchase, condemnation, or gift, a 
  7.25  fee title interest in lands which were previously privately 
  7.26  owned; and 
  7.27     (2) lands acquired by the state under chapter 84A that are 
  7.28  designated as state parks, state recreation areas, scientific 
  7.29  and natural areas, or wildlife management areas.  
  7.30     Sec. 5.  Minnesota Statutes 1998, section 477A.11, 
  7.31  subdivision 4, is amended to read: 
  7.32     Subd. 4.  [OTHER NATURAL RESOURCES LAND.] "Other natural 
  7.33  resources land" means:  
  7.34     (1) any other land presently owned in fee title by the 
  7.35  state and administered by the commissioner, or any tax-forfeited 
  7.36  land, other than platted lots within a city or those lands 
  8.1   described under subdivision 3, clause (2), which is owned by the 
  8.2   state and administered by the commissioner or by the county in 
  8.3   which it is located; and 
  8.4      (2) land leased by the state from the United States of 
  8.5   America through the United States Secretary of Agriculture 
  8.6   pursuant to Title III of the Bankhead Jones Farm Tenant Act, 
  8.7   which land is commonly referred to as land utilization project 
  8.8   land that is administered by the commissioner. 
  8.9      Sec. 6.  [ADDITIONS TO STATE FORESTS.] 
  8.10     Subdivision 1.  [89.021] [Subd. 5.] [BELTRAMI ISLAND STATE 
  8.11  FOREST.] The following areas are added to Beltrami Island state 
  8.12  forest:

 39.12     Subdivision 1.  [CLEAR LAKE WILDLIFE MANAGEMENT AREA, 
 39.13  AITKIN COUNTY.] The following areas are deleted from the Clear 
 39.14  Lake wildlife management area:  NE1/4-SW1/4 and Lot 5 of Section 
 39.15  3; Lot 1 and Lot 2 of Section 9; and NE1/4-NW1/4 of Section 10; 
 39.16  all in Township 49 North, Range 25 West. 
 39.17     Subd. 2.  [LONE PINE WILDLIFE MANAGEMENT AREA, AITKIN 
 39.18  COUNTY.] The following area is deleted from Lone Pine wildlife 
 39.19  management area:  S1/2-NW1/4 of Section 26, Township 48 North, 
 39.20  Range 23 West. 
 39.21     Sec. 9.  [MCGREGOR MARSH SCIENTIFIC AND NATURAL AREA.] 
 39.22     No dedication of any additional consolidated conservation 
 39.23  lands to the McGregor Marsh scientific and natural area may be 
 39.24  made until completion of the Aitkin county water planning task 
 39.25  force study regarding water issues in the city of McGregor.  
 39.26  Prior to any proposed dedication, the commissioner of natural 
 39.27  resources must hold a public hearing in the city of McGregor 
 39.28  concerning any proposed dedication.  Notice of the hearing must 
 39.29  be published at least once in a qualified newspaper that has its 
 39.30  known office of issue in the county seat of Aitkin county, and 
 39.31  the notice must be published at least seven days in advance of 
 39.32  the hearing.  Any lands dedicated must be subject to the 
 39.33  implementation of the water management actions, if any, 
 39.34  identified in the study. 
 39.35     Sec. 10.  [EXCHANGE PARCELS.] 
 39.36     Subdivision 1.  [LAND EXCHANGE.] If a land exchange is 
 40.1   offered to the state that, after evaluation by the department of 
 40.2   natural resources, is determined to (1) meet the state's natural 
 40.3   resources goals, and (2) meet all other land exchange 
 40.4   requirements under existing law, the parcels in subdivisions 2 
 40.5   to 6 shall be exchanged. 
 40.6      Subd. 2.  [AITKIN COUNTY.] Waukenabo state forest:  
 40.7   SW1/4-NE1/4 except part in Aitkin Municipal Airport runway clear 
 40.8   zone, NE1/4-SW1/4 except part in Aitkin Municipal Airport runway 
 40.9   clear zone, and NE1/4-SE1/4 of Section 18; that part of 
 40.10  NE1/4-SW1/4 lying north of Soo Railway right-of-way of Section 
 40.11  19; NE1/4-NE1/4 of Section 21; NW1/4 of Section 23; and

 42.26     Sec. 11.  [CONSOLIDATED-CONSERVATION LAND DISPOSITION 
 42.27  REPORT.] 
 42.28     (a) The commissioner of natural resources shall develop 
 42.29  recommendations on the designation of undesignated 
 42.30  consolidated-conservation lands that were subject to the 1991 
 42.31  commissioner's order classifying the lands as suitable for 
 42.32  wildlife management, research and habitat programs, public 
 42.33  hunting, and other recreational purposes.  
 42.34     (b) By June 30, 2000, a county with lands subject to the 
 42.35  1991 commissioner's order referenced in paragraph (a) may submit 
 42.36  a county board resolution to the commissioner of natural 
 43.1   resources requesting that the lands be reviewed by the 
 43.2   commissioner in consultation with the county board.  
 43.3      (c) By September 1, 2000, the commissioner shall hold at 
 43.4   least one public meeting on the designation of the 
 43.5   consolidated-conservation lands in each county for which the 
 43.6   commissioner receives a resolution from the county board under 
 43.7   paragraph (b). 
 43.8      (d) The commissioner, in consultation with a county board 
 43.9   that submitted a resolution in paragraph (b), shall develop 
 43.10  recommendations on the disposition of the lands referenced in 
 43.11  paragraph (a), including designating the lands: 
 43.12     (1) as state forests; 
 43.13     (2) as wildlife management areas; 
 43.14     (3) for both motorized and nonmotorized trail management; 
 43.15     (4) for other recreational or conservation management, 
 43.16  including joint management between the department's divisions 
 43.17  that would allow for multiple recreational uses; or 
 43.18     (5) sale or exchange of lands that are not appropriate for 
 43.19  conservation or recreation purposes. 
 43.20     (e) By October 1, 2000, the commissioner must report the 
 43.21  commissioner's draft recommendations on the disposition of the 
 43.22  lands to the county boards with lands subject to paragraph (a). 
 43.23     (f) By December 1, 2000, each county board that submitted a 
 43.24  resolution under paragraph (b) may submit a resolution providing 
 43.25  comments on the proposed draft recommendations in paragraph (e). 
 43.26     (g) By January 15, 2001, the commissioner shall report to 
 43.27  the legislative policy and finance committees with jurisdiction 
 43.28  over natural resources on final recommendations for disposition 
 43.29  of the consolidated-conservation lands referenced in paragraph 
 43.30  (a).  The report must include copies of the resolutions 
 43.31  submitted under paragraph (f). 
 43.32     Sec. 12.  [ISOLATED CONSOLIDATED-CONSERVATION LANDS.] 
 43.33     (a) By January 15, 2001, the commissioner of natural 
 43.34  resources shall report to the legislative policy and finance 
 43.35  committees with jurisdiction over natural resources on 
 43.36  recommendations for disposition of isolated 
 44.1   consolidated-conservation lands in areas that were subject to 
 44.2   the 1989 and 1991 commissioner's orders classifying the lands as 
 44.3   suitable for wildlife management, research and habitat programs, 
 44.4   public hunting, and other recreational purposes. 
 44.5      (b) The recommendations under paragraph (a) may include 
 44.6   designation, exchange, or sale of isolated 
 44.7   consolidated-conservation lands.  Isolated 
 44.8   consolidated-conservation lands that are not appropriate for 
 44.9   conservation and recreation purposes may be recommended for sale 
 44.10  or exchange. 
 44.11     (c) For the purposes of this section, "isolated 
 44.12  consolidated-conservation lands" are parcels of 
 44.13  consolidated-conservation land of 40 acres or less that are not 
 44.14  contiguous with other public land. 
 44.15     Sec. 13.  [INSTRUCTION TO REVISOR; EFFECT OF SESSION LAW 
 44.16  DESCRIPTIONS.] 
 44.17     (a) The revisor need not include the legal descriptions for 
 44.18  state wildlife management areas under Minnesota Statutes, 
 44.19  section 97A.133, but must include a history of the session laws 
 44.20  establishing or amending the boundaries of state wildlife 
 44.21  management areas under each subdivision in the same manner as 
 44.22  provided for state parks under Minnesota Statutes, section 
 44.23  85.012.  
 44.24     (b) The lands described in the session laws establishing or 
 44.25  changing the boundaries of each state wildlife management area 
 44.26  are included in the state wildlife management areas as 
 44.27  established or changed. 
 44.28     Sec. 14.  [EFFECTIVE DATE.] 
 44.29     Sections 1 to 3 and 6 to 13 are effective the day following 
 44.30  final enactment.  Sections 4 and 5 apply to payments made in 
 44.31  calendar year 2001 and thereafter.
