A bill for an act
relating to public safety; requiring the disclosure of the results of a preliminary
screening test to the driver who took the test and making the results inadmissable
if not disclosed; amending Minnesota Statutes 2008, section 169A.41, by adding
a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 169A.41, is amended by adding a
subdivision to read:

new text begin After the administration of a preliminary
screening test and upon the demand of the driver or the driver's attorney, the peace officer
who administered the test shall immediately disclose the results to the driver or attorney.
A test result recorded in any numerical manner must be disclosed in the same numerical
manner. The failure or refusal, by the peace officer, to comply with this subdivision shall
result in the exclusion of all of the test results in any proceeding described in subdivision 2
or under section 169A.53.
