  1.1                          A bill for an act 
  1.2             relating to hazardous substances; regulating the 
  1.3             installation and repair of piping containing hazardous 
  1.4             substances; amending Minnesota Statutes 2000, sections 
  1.5             326.461, subdivision 2, by adding a subdivision; 
  1.6             326.47, by adding a subdivision; 326.48, by adding a 
  1.7             subdivision; 326.521. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 326.461, 
  1.10  subdivision 2, is amended to read: 
  1.11     Subd. 2.  [HIGH PRESSURE PIPING.] "High pressure piping" 
  1.12  means all high pressure piping used in the installation of hot 
  1.13  water or steam heating boilers, any systems of piping hot water 
  1.14  or other medium used for heating that exceed 30 p.s.i. gauge and 
  1.15  250 degrees Fahrenheit, any system of piping hazardous 
  1.16  substances as defined in subdivision 2a, or any system of high 
  1.17  pressure steam or ammonia piping, but shall not include any high 
  1.18  pressure piping under the direct jurisdiction of the United 
  1.19  States. 
  1.20     Sec. 2.  Minnesota Statutes 2000, section 326.461, is 
  1.21  amended by adding a subdivision to read: 
  1.22     Subd. 2a.  [HAZARDOUS SUBSTANCE.] "Hazardous substance" 
  1.23  means a substance or mixture as defined in section 182.651, 
  1.24  subdivision 14, or a substance or mixture determined by the 
  1.25  commissioner of labor and industry to present significant risk 
  1.26  to public health and safety in the event of an intentional 
  2.1   release of the substance. 
  2.2      Sec. 3.  Minnesota Statutes 2000, section 326.47, is 
  2.3   amended by adding a subdivision to read: 
  2.4      Subd. 7.  [ALLOWING ENTRY FOR INSPECTION.] No person shall 
  2.5   interfere with or refuse entry to an inspector lawfully engaged 
  2.6   in the duties of inspecting hazardous substance piping. 
  2.7      Sec. 4.  Minnesota Statutes 2000, section 326.48, is 
  2.8   amended by adding a subdivision to read: 
  2.9      Subd. 1a.  [HAZARDOUS SUBSTANCE LICENSE REQUIREMENTS.] The 
  2.10  requirements of this subdivision supersede the licensing 
  2.11  provisions of subdivision 1 with respect to hazardous piping.  
  2.12  No person shall install, repair, or alter piping, appurtenances, 
  2.13  and equipment for the purpose of containing hazardous substances 
  2.14  used to produce a product unless issued an individual 
  2.15  contracting pipefitter license by the department of labor and 
  2.16  industry or a license to do plumbing work under section 326.40 
  2.17  by the department of health.  Alteration and repair performed by 
  2.18  a manufacturer's production employees on piping, appurtenances, 
  2.19  and equipment within the limits of property which is owned or 
  2.20  leased by a manufacturer are exempt from the requirements of 
  2.21  this subdivision, except that a manufacturer must have an 
  2.22  individual holding a master pipefitting or a master plumbing 
  2.23  license on site at all times while alteration and repair work is 
  2.24  done. 
  2.25     Sec. 5.  Minnesota Statutes 2000, section 326.521, is 
  2.26  amended to read: 
  2.27     326.521 [VIOLATIONS; PENALTY PROVISIONS.] 
  2.28     Unless otherwise specifically provided, any violation of 
  2.29  any provision or requirement of sections 326.46 to 326.52 is a 
  2.30  misdemeanor.  It is a misdemeanor to make a false statement in 
  2.31  any license application, request for inspection, certificate, or 
  2.32  other lawfully authorized or required form or statement provided 
  2.33  to inspectors.
