  1.1                          A bill for an act 
  1.2             relating to the city of Duluth; authorizing the city 
  1.3             council to establish or grant additional powers to a 
  1.4             human rights commission. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [DULUTH HUMAN RIGHTS COMMISSION.] 
  1.7      Notwithstanding any statute, city charter provision, or 
  1.8   ordinance to the contrary, and in addition to all other powers 
  1.9   conferred by statute or charter, the city council of the city of 
  1.10  Duluth may, by ordinance, establish a human rights commission or 
  1.11  grant additional powers to an existing human rights commission 
  1.12  so that the rights and remedies afforded to persons claiming 
  1.13  discriminatory housing practices qualify the human rights 
  1.14  commission as a substantially equivalent agency under the 
  1.15  regulations of the federal Department of Housing and Urban 
  1.16  Development in Code of Federal Regulations, title 24, part 115, 
  1.17  subpart B. 
  1.18     Sec. 2.  [REMEDIES; ENFORCEMENT.] 
  1.19     The human rights commission authorized by this act may 
  1.20  impose and, through the district court, enforce any remedy, 
  1.21  sanction, or penalty enumerated in Code of Federal Regulations, 
  1.22  title 24, section 115.202, in housing discrimination cases.  The 
  1.23  district court has jurisdiction to enforce the remedies, 
  1.24  sanctions, or penalties when they are imposed by the human 
  1.25  rights commission operating under this act in housing 
  2.1   discrimination cases.  The district court also has jurisdiction 
  2.2   to impose and enforce the remedies, sanctions, or penalties in 
  2.3   the exercise of its jurisdiction to enforce the housing 
  2.4   discrimination provisions of the human rights ordinance of the 
  2.5   city of Duluth, if the ordinance provides that original 
  2.6   enforcement jurisdiction is in the district court.  The time for 
  2.7   filing a claim with the human rights commission or as an 
  2.8   original civil action in the district court cannot exceed the 
  2.9   time for filing a claim under Minnesota Statutes, section 
  2.10  363.06, subdivision 3.  A party aggrieved by a final decision or 
  2.11  order of the commission may seek judicial review in the district 
  2.12  court within the time provided in cases of district court 
  2.13  judicial review of local government action. 
  2.14     Sec. 3.  [EFFECTIVE DATE; LOCAL APPROVAL.] 
  2.15     Sections 1 and 2 are effective the day after the governing 
  2.16  body of the city of Duluth and its chief clerical officer timely 
  2.17  complete their compliance with Minnesota Statutes, section 
  2.18  645.021, subdivisions 2 and 3.
