A bill for an act
relating to education; requiring schools to maintain a supply of non-patient-specific
epinephrine auto-injectors; amending Minnesota Statutes 2020, section 121A.2207.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2020, section 121A.2207, is amended to read:
Notwithstanding section 151.37, districts and schools deleted text begin maydeleted text end new text begin must new text end obtain and possess
new text begin a minimum stock of at least two new text end epinephrine auto-injectors to be maintained and administered
by school personnel to a student or other individual if, in good faith, it is determined that
person is experiencing anaphylaxis regardless of whether the student or other individual
has a prescription for an epinephrine auto-injector. The administration of deleted text begin andeleted text end new text begin a
non-patient-specificnew text end epinephrine auto-injector in accordance with this section is not the
practice of medicine.
A district or school may enter into
arrangements with manufacturers of epinephrine auto-injectors to obtain epinephrine
auto-injectors at fair-market, free, or reduced pricesnew text begin , such as through the national
EpiPens4Schools program or other similar programs implemented under the School Access
to Emergency Epinephrine Actnew text end . A third party, other than a manufacturer or supplier, may
pay for a school's supply of epinephrine auto-injectors.
