A bill for an act
relating to natural resources; establishing Lake Vermilion State Park; amending
Minnesota Statutes 2006, section 85.012, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 85.012, is amended by adding a
subdivision to read:

Lake Vermilion State Park, St. Louis County.

Lake Vermilion State Park is
established in St. Louis County.

All lands acquired for Lake Vermilion State Park must be
administered in the same manner as provided for other state parks and must be perpetually
dedicated for that use.

The following described lands are located within the
boundaries of Lake Vermilion State Park:

(1) Government Lots 4, 5, 6, 7, 8, 9, and the South Half of the Southeast Quarter, all
in Section 13, Township 62 North, Range 15 West;

(2) Government Lots 6 and 8, Section 14, Township 62 North, Range 15 West;
new text end
new text begin
(3) Government Lots 1 and 7 and the Northeast Quarter of the Southeast Quarter, all
in Section 22, Township 62 North, Range 15 West;

(4) Government Lots 1, 2, 3, 4, the Southeast Quarter of the Northeast Quarter, and
the South Half, all in Section 23, Township 62 North, Range 15 West;

(5) all of Section 24, Township 62 North, Range 15 West;

(6) all of Section 25, Township 62 North, Range 15 West;

line of State Highway 169;

(8) the Southeast Quarter of the Northeast Quarter and the Northeast Quarter of the
Southeast Quarter of Section 27, Township 62 North, Range 15 West;

North, Range 15 West, except that part lying South of the centerline of the McKinley
Park Road; and

Within 24 months of the acquisition of land
for the state park established in subdivision 1, the commissioner of natural resources, with
the approval of the Land Exchange Board as required under the Minnesota Constitution,
article XI, section 10, and according to the provisions of Minnesota Statutes, sections
94.343 to 94.347, shall exchange all land acquired within the boundaries of the established
state park for school trust lands, as defined in Minnesota Statutes, section 92.025, that
are located within St. Louis County. After the exchange, state-owned lands within the
boundaries of the state park established in subdivision 1 shall be school trust lands and
subject to the same trust as the lands given in exchange for the lands within the boundaries
of the state park.

Notwithstanding Minnesota Statutes, sections 85.052,
subdivision 4, paragraph (a), and 85.055, subdivision 2, all fees collected for state permits,
services, and special state park uses at the state park established in subdivision 1 shall
be deposited in the school trust fund, established in the Minnesota Constitution, article
XI, section 8.

Notwithstanding Minnesota
Statutes, sections 94.09 and 94.10, and any other law to the contrary, all land given in
exchange for lands within the boundaries of the state park established in subdivision 1
shall be conveyed to St. Louis County for no consideration.

The commissioner of natural resources may acquire by gift or purchase the lands
for Lake Vermilion State Park. Minnesota Statutes, section 84.0272, subdivision 1, does
not apply to a purchase, except for the requirement that the lands be appraised. Prior to
the purchase of any land within the boundaries described, the state must receive from St.
Louis County a resolution supporting the purchase.

Sections 1 and 2 are effective upon acquisition by the state of all lands described in
section 2, subdivision 3. Section 3 is effective the day following final enactment.
