A bill for an act
relating to health; creating an exemption to the prohibition of minors using
tanning equipment at a tanning facility for medical reasons; amending Minnesota
Statutes 2014, section 325H.085.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 325H.085, is amended to read:


325H.085 USE BY MINORS PROHIBITED.

new text begin (a) new text endA person under age 18 may not use any type of tanning equipment as defined by
section 325H.01, subdivision 6, available in a tanning facility in this state.

new text begin (b) Notwithstanding paragraph (a), a person under the age of 18 may use tanning
equipment at a tanning facility if the person has documentation signed by a health care
provider indicating a medical need for the person to use the tanning equipment for
purposes of treating a medical or mental condition or disorder, and the person's parent or
legal guardian signs a consent form prior to the initial exposure at the tanning facility.
