  1.1                          A bill for an act 
  1.2             relating to human services; creating a noncash 
  1.3             assistance program for families that include a child 
  1.4             with special needs; amending Minnesota Statutes 1998, 
  1.5             section 256J.49, subdivision 13; proposing coding for 
  1.6             new law in Minnesota Statutes, chapter 256J. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 256J.49, 
  1.9   subdivision 13, is amended to read: 
  1.10     Subd. 13.  [WORK ACTIVITY.] "Work activity" means any 
  1.11  activity in a participant's approved employment plan that is 
  1.12  tied to the participant's employment goal.  For purposes of the 
  1.13  MFIP-S program, any activity that is included in a participant's 
  1.14  approved employment plan meets the definition of work activity 
  1.15  as counted under the federal participation standards.  Work 
  1.16  activity includes, but is not limited to: 
  1.17     (1) unsubsidized employment; 
  1.18     (2) subsidized private sector or public sector employment, 
  1.19  including grant diversion as specified in section 256J.69; 
  1.20     (3) work experience, including CWEP as specified in section 
  1.21  256J.67, and including work associated with the refurbishing of 
  1.22  publicly assisted housing if sufficient private sector 
  1.23  employment is not available; 
  1.24     (4) on-the-job training as specified in section 256J.66; 
  1.25     (5) job search, either supervised or unsupervised; 
  1.26     (6) job readiness assistance; 
  2.1      (7) job clubs, including job search workshops; 
  2.2      (8) job placement; 
  2.3      (9) job development; 
  2.4      (10) job-related counseling; 
  2.5      (11) job coaching; 
  2.6      (12) job retention services; 
  2.7      (13) job-specific training or education; 
  2.8      (14) job skills training directly related to employment; 
  2.9      (15) the self-employment investment demonstration (SEID), 
  2.10  as specified in section 256J.65; 
  2.11     (16) preemployment activities, based on availability and 
  2.12  resources, such as volunteer work, literacy programs and related 
  2.13  activities, citizenship and English as a second language 
  2.14  classes, or participation in dislocated worker services, 
  2.15  chemical dependency treatment, mental health services, peer 
  2.16  group networks, displaced homemaker programs, strength-based 
  2.17  resiliency training, parenting education, or other programs 
  2.18  designed to help families reach their employment goals and 
  2.19  enhance their ability to care for their children; 
  2.20     (17) community service programs; 
  2.21     (18) vocational educational training or educational 
  2.22  programs that can reasonably be expected to lead to employment, 
  2.23  as limited by the provisions of section 256J.53; 
  2.24     (19) apprenticeships; 
  2.25     (20) satisfactory attendance in general educational 
  2.26  development diploma classes or an adult diploma program; 
  2.27     (21) satisfactory attendance at secondary school, if the 
  2.28  participant has not received a high school diploma; 
  2.29     (22) adult basic education classes; 
  2.30     (23) internships; 
  2.31     (24) bilingual employment and training services; 
  2.32     (25) providing child care services to a participant who is 
  2.33  working in a community service program; and 
  2.34     (26) activities included in a safety plan that is developed 
  2.35  under section 256J.52, subdivision 6; and 
  2.36     (27) providing care to a special needs child who is either 
  3.1   part of the care provider's assistance unit or part of another 
  3.2   assistance unit.  A special needs child is a child with a 
  3.3   physical, emotional, or mental condition requiring additional 
  3.4   care. 
  3.5      Sec. 2.  [256J.96] [FAMILIES WITH SPECIAL NEEDS CHILDREN.] 
  3.6      A family that is eligible for MFIP that includes a child 
  3.7   with special needs shall become part of the noncash assistance 
  3.8   program under this section.  A special needs child is a child 
  3.9   with a physical, emotional, or mental condition requiring 
  3.10  additional care.  The amount provided to the family to care for 
  3.11  the child must be the same as the amount provided under MFIP for 
  3.12  the same family size and composition. 
  3.13     Sec. 3.  [NONCASH ASSISTANCE.] 
  3.14     The noncash assistance provided under Minnesota Statutes, 
  3.15  section 256J.96, does not count against the 60-month time limit.
