  1.1                          A bill for an act 
  1.2             relating to education; providing that children have 
  1.3             healthy a la carte options in Minnesota's school lunch 
  1.4             program; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 124D. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [124D.1112] [A LA CARTE SCHOOL LUNCH.] 
  1.8      (a) The definitions in this paragraph apply to this section.
  1.9      (1) "A la carte" means food items that are available for 
  1.10  students to purchase during lunch.  These food items are sold 
  1.11  separately from meals that are part of the national school lunch 
  1.12  program. 
  1.13     (2) "Lunch" means the meal served by the school or the 
  1.14  school's food service provider during the day in accordance with 
  1.15  the national school lunch program. 
  1.16     (3) "RDA" means recommended daily allowances, as determined 
  1.17  by the United States Department of Agriculture. 
  1.18     (4) "School" means a public school building or the portion 
  1.19  of a building that includes classrooms and educational 
  1.20  facilities for students in kindergarten through grade 12. 
  1.21     (b) A school or district offering a la carte items for 
  1.22  students to purchase at lunch must only offer a la carte items 
  1.23  that: 
  1.24     (1) have no more than 30 percent of their calories derived 
  1.25  from fat with less than ten percent of their fat content derived 
  2.1   from saturated fats; and 
  2.2      (2) provide at least 15 percent of the RDA of calcium or 
  2.3   ten percent of the RDA of three or more vitamins or minerals. 
  2.4      (c) Paragraph (b) does not apply to nuts, fruits, or 
  2.5   vegetables. 
  2.6      (d) A school or district selling a la carte food items must 
  2.7   offer a selection of fresh fruits and vegetables. 
  2.8      (e) Whenever possible, a school or district should provide 
  2.9   whole grain, rather than refined grain, a la carte items. 
  2.10     [EFFECTIVE DATE.] This section is effective for the 
  2.11  2004-2005 school year and later.
