A bill for an act
relating to solid waste; modifying closure requirements for solid waste disposal
facilities; amending Minnesota Statutes 2018, section 116.07, subdivision 4f.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 116.07, subdivision 4f, is amended to read:


Subd. 4f.

Closure and postclosure responsibility and liability.

owner of a facility is responsible for closure of the facility and postclosure care relating to
the facility. If an owner or operator has failed to provide the required closure or postclosure
care of the facilitynew text begin ,new text end the agency may take the actions. The owner or operator is liable for the
costs of the required closure and postclosure care taken by the agency.

new text begin (b) If the remaining capacity of a solid waste disposal facility is less than 1.5 percent of
the facility's design capacity based on the facility's most recent annual report, the owner or
operator of the facility must complete the required closure of the facility within 24 months
of the date the annual report was submitted or within 24 months of the effective date of this
section, whichever is later. The commissioner may issue a permit to continue operating the
facility until closure is completed or may approve an alternative timeline to complete the
closure.
