  1.1                          A bill for an act
  1.2             relating to education; authorizing the use of health 
  1.3             and safety revenue for new construction under certain 
  1.4             circumstances; amending Minnesota Statutes 1996, 
  1.5             section 124.83, subdivision 6, and by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 124.83, 
  1.9   subdivision 6, is amended to read: 
  1.10     Subd. 6.  [USES OF HEALTH AND SAFETY REVENUE.] Health and 
  1.11  safety revenue may be used only for approved expenditures 
  1.12  necessary to correct fire safety hazards, life safety hazards, 
  1.13  or for the removal or encapsulation of asbestos from school 
  1.14  buildings or property, asbestos-related repairs, cleanup and 
  1.15  disposal of polychlorinated biphenyls found in school buildings 
  1.16  or property, or the cleanup, removal, disposal, and repairs 
  1.17  related to storing heating fuel or transportation fuels such as 
  1.18  alcohol, gasoline, fuel oil, and special fuel, as defined in 
  1.19  section 296.01, labor and industry regulated facility and 
  1.20  equipment hazards, and health, safety, and environmental 
  1.21  management.  Health and safety revenue must not be used for the 
  1.22  construction of new facilities or the purchase of portable 
  1.23  classrooms except as provided under subdivision 6a.  The revenue 
  1.24  may not be used for a building or property or part of a building 
  1.25  or property used for post-secondary instruction or 
  1.26  administration or for a purpose unrelated to elementary and 
  2.1   secondary education. 
  2.2      Sec. 2.  Minnesota Statutes 1996, section 124.83, is 
  2.3   amended by adding a subdivision to read: 
  2.4      Subd. 6a.  [NEW CONSTRUCTION.] A school district may use 
  2.5   health and safety revenue for construction of classroom space 
  2.6   only if it is replacing a portable classroom and only if the 
  2.7   following conditions have been met: 
  2.8      (1) the district has held a hearing on the proposed 
  2.9   replacement and adopted a written resolution authorizing the new 
  2.10  construction; 
  2.11     (2) the district has submitted the written resolution to 
  2.12  the department of children, families, and learning and has 
  2.13  requested and received a favorable review and comment of the 
  2.14  project under section 121.15, if the cost of the new 
  2.15  construction exceeds $100,000; and 
  2.16     (3) the district can demonstrate that the new construction 
  2.17  is cost-efficient when compared to the cost of making health and 
  2.18  safety repairs to the portable classroom. 
  2.19     Sec. 3.  [EFFECTIVE DATE.] 
  2.20     Sections 1 and 2 are effective the day following final 
  2.21  enactment.
