A bill for an act
 relating to public safety; expanding the offense of assaulting a minor; establishing
the offense of assault in the third degree by strangulation; amending Minnesota
Statutes 2018, section 609.223, subdivision 3, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 609.223, subdivision 3, is amended to read:


Subd. 3.

Whoever assaults a new text begin minor new text end victim deleted text begin under the
age of four,deleted text end and causes bodily harm to the deleted text begin child'sdeleted text end head, eyes, or neck, or otherwise causes
multiple bruises to the body, is guilty of a felony and may be sentenced to imprisonment
for not more than five years or to payment of a fine of not more than $10,000, or bothdeleted text begin .deleted text end new text begin if:

new text begin (1) the victim is under the age of four; or

new text begin (2) the victim is at least four but less than 18 years of age and the actor is at least 18
years of age and more than 60 months older than the victim.

committed on or after that date.

Sec. 2.

Minnesota Statutes 2018, section 609.223, is amended by adding a subdivision to
read:

new text begin Assault by strangulation. new text end

new text begin Whoever assaults another by strangulation is guilty
of a felony and may be sentenced to imprisonment for not more than three years or to
payment of a fine of not more than $5,000, or both. For purposes of this subdivision,
"strangulation" has the meaning given in section 609.2247, subdivision 1, paragraph (c).
