  1.1                          A bill for an act 
  1.2             relating to crime; increasing penalties for certain 
  1.3             drug paraphernalia violations; amending Minnesota 
  1.4             Statutes 2002, sections 152.092; 152.093. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 152.092, is 
  1.7   amended to read: 
  1.8      152.092 [POSSESSION OF DRUG PARAPHERNALIA PROHIBITED.] 
  1.9      It is unlawful for any person knowingly or intentionally to 
  1.10  use or to possess drug paraphernalia.  Any If the drug 
  1.11  paraphernalia is used, or possessed with the intent to be used, 
  1.12  with a controlled substance, other than marijuana, classified in 
  1.13  schedule I, II, or III of section 152.02, the person is guilty 
  1.14  of a misdemeanor.  Otherwise a violation of this section is a 
  1.15  petty misdemeanor.  
  1.16     [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  1.17  and applies to crimes committed on or after that date. 
  1.18     Sec. 2.  Minnesota Statutes 2002, section 152.093, is 
  1.19  amended to read: 
  1.20     152.093 [MANUFACTURE OR DELIVERY OF DRUG PARAPHERNALIA 
  1.21  PROHIBITED.] 
  1.22     It is unlawful for any person knowingly or intentionally to 
  1.23  deliver drug paraphernalia or knowingly or intentionally to 
  1.24  possess or manufacture drug paraphernalia for delivery.  Any If 
  1.25  the drug paraphernalia is intended for use with a controlled 
  2.1   substance, other than marijuana, classified in schedule I, II, 
  2.2   or III of section 152.02, the person is guilty of a gross 
  2.3   misdemeanor.  Otherwise a violation of this section is a 
  2.4   misdemeanor.  
  2.5      [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  2.6   and applies to crimes committed on or after that date.
