  1.1                          A bill for an act 
  1.2             relating to human services; providing an annual rate 
  1.3             adjustment for certain programs; appropriating money; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 256. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [256.9665] [ANNUAL PROVIDER RATE INCREASES.] 
  1.8      (a) Beginning July 1, 1999, and each July 1 thereafter, the 
  1.9   commissioner shall increase reimbursement or allocation rates 
  1.10  and county boards shall adjust provider contracts as needed for 
  1.11  the providers specified in paragraph (b).  Reimbursement or 
  1.12  allocation rates shall be increased by the forecasted annual 
  1.13  percentage change in the Consumer Price Index-All Urban (CPI-U) 
  1.14  for the fiscal year beginning July 1 compared to the previous 
  1.15  fiscal year.  The forecast to be used shall be the one published 
  1.16  by Data Resources, Inc., for the calendar quarter beginning the 
  1.17  January 1 prior to the effective date of the rate increase. 
  1.18     (b) The following providers shall receive a rate increase 
  1.19  as determined under paragraph (a):  hospital services under 
  1.20  section 256.969; nursing facility services under sections 
  1.21  256B.431 and 256B.434; intermediate care facility services for 
  1.22  persons with mental retardation under section 256B.501; home and 
  1.23  community-based waiver services for persons with mental 
  1.24  retardation or related conditions under section 256B.501; home 
  1.25  and community-based waiver services for the elderly under 
  2.1   section 256B.0915; waivered services under community 
  2.2   alternatives for disabled individuals under section 256B.49; 
  2.3   community alternative care waivered services under section 
  2.4   256B.49; traumatic brain injury waivered services under section 
  2.5   256B.49; nursing services and home health services under section 
  2.6   256B.0625, subdivision 6a; personal care services and nursing 
  2.7   supervision of personal care services under section 256B.0625, 
  2.8   subdivision 19a; private duty nursing services under section 
  2.9   256B.0625, subdivision 7; day training and habilitation services 
  2.10  for adults with mental retardation or related conditions under 
  2.11  sections 252.40 to 252.46; physical therapy services under 
  2.12  sections 256B.0625, subdivision 8, and 256D.03, subdivision 4; 
  2.13  occupational therapy services under sections 256B.0625, 
  2.14  subdivision 8a, and 256D.03, subdivision 4; speech-language 
  2.15  therapy services under section 256D.03, subdivision 4, and 
  2.16  Minnesota Rules, part 9505.0390; respiratory therapy services 
  2.17  under section 256D.03, subdivision 4, and Minnesota Rules, part 
  2.18  9505.0295; dental services under sections 256B.0625, subdivision 
  2.19  9, and 256D.03, subdivision 4; alternative care services under 
  2.20  section 256B.0913; adult residential program grants under 
  2.21  Minnesota Rules, parts 9535.2000 to 9535.3000; adult and family 
  2.22  community support grants under Minnesota Rules, parts 9535.1700 
  2.23  to 9535.1760; and semi-independent living services under section 
  2.24  252.275, including SILS funding under county social services 
  2.25  grants formerly funded under chapter 256I.  
  2.26     (c) The commissioner shall increase prepaid medical 
  2.27  assistance program capitation rates as necessary to reflect the 
  2.28  rate increases in this section.
