A bill for an act
relating to health care; prohibiting the use of discounts or free product vouchers
for certain prescription drugs; proposing coding for new law in Minnesota
Statutes, chapter 151.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) A drug manufacturer, wholesale drug distributor, or any agent thereof is
prohibited from offering or providing any discount, rebate, product voucher, or
other reduction to an individual's out-of-pocket expenses, including co-payments
and deductibles for any prescription drug that has an AB-rated generic equivalent as
determined by the United States Food and Drug Administration. This prohibition includes
discounts, rebates, product vouchers, or other reductions that are provided directly or
electronically to an individual or through a mail-in rebate, or other similar means, or
provided by a prescriber or pharmacy at point of sale.

(b) Nothing in this section restricts a drug manufacturer in terms of how the
manufacturer distributes a prescription drug, or affects the obligations of a prescriber or
pharmacist under section 151.21.
