  1.1                          A bill for an act
  1.2             relating to highways; requiring construction of noise 
  1.3             barriers on trunk highways in certain instances; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 161. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [161.126] [CONSTRUCTION OF METROPOLITAN NOISE 
  1.8   BARRIERS.] 
  1.9      The commissioner shall construct noise barriers on segments 
  1.10  of the trunk highway system that (1) are in the Department of 
  1.11  Transportation's metropolitan construction district, (2) are 
  1.12  located in primarily residential areas, and (3) have one or more 
  1.13  shoulder lanes constructed, striped, or otherwise designated 
  1.14  exclusively for buses.  To the maximum feasible extent, the 
  1.15  commissioner shall seek federal transportation enhancement funds 
  1.16  or other federal surface transportation funds to pay a portion 
  1.17  of the cost of noise barriers required under this section.  The 
  1.18  commissioner shall pay all costs of noise barriers required 
  1.19  under this section that are not paid from federal sources from 
  1.20  funds appropriated to the commissioner for state road 
  1.21  construction.
