  1.1                          A bill for an act 
  1.2             relating to civil actions; limiting liability for 
  1.3             damages in certain actions against air museums and 
  1.4             their officers, directors, and employees, and the 
  1.5             owners of aircraft exhibits; proposing coding for new 
  1.6             law in Minnesota Statutes, chapter 604A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [604A.36] [AIR MUSEUMS; LIABILITY LIMITATION.] 
  1.9      Subdivision 1.  [DEFINITION.] An "air museum" is a location 
  1.10  where historical aircraft and other related memorabilia are 
  1.11  displayed in a stationary position for viewing by the general 
  1.12  public. 
  1.13     Subd. 2.  [LIMITATION.] If a liability insurance policy has 
  1.14  been issued to a museum and/or aircraft owner in the amount of 
  1.15  at least $2,000,000, the museum and its officers, directors, and 
  1.16  employees, and the owner of any exhibit displayed in the museum 
  1.17  with the exhibit owner's authorization, are not liable for money 
  1.18  damages in excess of the amount of the policy limits of all 
  1.19  applicable insurance coverage to a spectator for injuries 
  1.20  occurring in the premises of the air museum. 
  1.21     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.22     Section 2 is effective August 1, 2004, for causes of action 
  1.23  arising on or after that date.
