A bill for an act
relating to environment; requiring rulemaking to limit greenhouse gas emissions
from certain industrial air permittees; requiring incentives to reduce greenhouse
gas emissions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) No later than November 1, 2024, the
commissioner of the Pollution Control Agency must adopt rules to ensure that greenhouse
gas emissions from industrial facilities requiring one or more air permits, other than electric
utilities as defined in Minnesota Statutes, section 216B.1691, subdivision 1, are reduced by
an amount sufficient to achieve the greenhouse gas emissions reduction goals set forth in
Minnesota Statutes, section 216H.02.

new text begin (b) Rules adopted under this section must be designed to eliminate energy cost burdens
and air pollution and to increase access to beneficial clean energy technology and job
opportunities in environmental justice areas, as defined in Minnesota Statutes, section
216B.1691, subdivision 1. Rules adopted under this section must not impose a
disproportionate pollution burden on environmental justice areas.

new text begin The commissioner must establish an incentive program to provide
technical and financial assistance to industrial air permitees subject to the rules adopted
under this section. The incentives must encourage and assist permittees in adopting clean
fuel sources, increasing energy efficiency, and taking other actions to enable significant
greenhouse gas emissions reductions.
