  1.1                          A bill for an act 
  1.2             relating to education; extending interactive Web-based 
  1.3             and independent study programs; amending Laws 2001, 
  1.4             First Special Session chapter 6, article 4, section 
  1.5             25; section 27, subdivision 9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 2001, First Special Session chapter 6, 
  1.8   article 4, section 25, is amended to read: 
  1.9      Sec. 25.  [INTERACTIVE WEB-BASED AND INDEPENDENT STUDY 
  1.10  PROGRAMS.] 
  1.11     Subdivision 1.  [PUPIL REVENUE.] (a) General education 
  1.12  revenue for an eligible pupil in an approved interactive 
  1.13  Web-based program offered by a school district or a charter 
  1.14  school, or an approved alternative program that has an 
  1.15  independent study component offered by a charter school, under 
  1.16  the supervision of a teacher with a Minnesota license, must be 
  1.17  paid for each hour of completed coursework needed for grade 
  1.18  progression, credit, or alignment with state graduation 
  1.19  standards.  For purposes of this section, an eligible pupil is a 
  1.20  public school pupil concurrently enrolled in the district or 
  1.21  charter school or concurrently enrolled in another district or 
  1.22  charter school and participating in the program by agreement 
  1.23  with the district or charter school of enrollment.  The course 
  1.24  of study must be approved by the commissioner of children, 
  1.25  families, and learning for alignment with the state graduation 
  2.1   standards and compliance with Minnesota Statutes, chapter 125A.  
  2.2   An alternative program that has an independent study component 
  2.3   must also meet the requirements of Minnesota Statutes, section 
  2.4   126C.05, subdivision 15, paragraph (b), clauses (i) and (iv).  
  2.5   Average daily membership for a pupil shall equal the number of 
  2.6   hours of coursework completed divided by the number of hours 
  2.7   required for a full-time student in the district or charter 
  2.8   school.  Pupils enrolled in the program must not be counted as 
  2.9   more than 1.0 pupil in average daily membership.  A school 
  2.10  district or charter school is not required to provide a pupil 
  2.11  enrolled in the program with access to a computer or to the 
  2.12  Internet. 
  2.13     (b) Notwithstanding paragraph (a), pupils enrolled in a 
  2.14  Web-based public alternative program approved by the 
  2.15  commissioner before June 1, 2001, are not required to be 
  2.16  concurrently enrolled in the district and may be counted as more 
  2.17  than 1.0 pupil in average daily membership under Minnesota 
  2.18  Statutes, section 126C.05, subdivision 15. 
  2.19     (c) Notwithstanding paragraph (a), pupils enrolled in a 
  2.20  charter school with a Web-based program, approved by the 
  2.21  commissioner before June 1, 2001, are not required to be 
  2.22  concurrently enrolled in the charter school. 
  2.23     (d) Notwithstanding paragraph (a), pupils enrolled in a 
  2.24  charter school with an alternative program that has an 
  2.25  independent study component, approved by the commissioner for 
  2.26  fiscal year 2001, may be counted as more than 1.0 pupil in 
  2.27  average daily membership under Minnesota Statutes, section 
  2.28  126C.05, subdivision 15, paragraph (b), clause (iii). 
  2.29     Subd. 2.  [REIMBURSEMENT.] Notwithstanding Minnesota 
  2.30  Statutes, section 126C.19, subdivision 4, for fiscal year years 
  2.31  2002 and 2003 only, the commissioner shall establish a process 
  2.32  for providing additional revenue to school districts or charter 
  2.33  schools for: 
  2.34     (1) an eligible pupil in an approved interactive Web-based 
  2.35  program under subdivision 1, paragraph (a), that may be counted 
  2.36  as more than 1.0 pupil in average daily membership; or 
  3.1      (2) a nonpublic pupil in an approved interactive Web-based 
  3.2   program in a public school under subdivision 1, paragraph (a).  
  3.3   The commissioner may award additional general education revenue 
  3.4   to school districts and charter schools up to the amount 
  3.5   appropriated for this section.  The amount of additional revenue 
  3.6   awarded to a school district under this section shall be based 
  3.7   on additional pupils in average daily membership that are 
  3.8   generated according to this subdivision with the prior approval 
  3.9   from the commissioner.  The commissioner shall establish a 
  3.10  process to prioritize the awards under this subdivision based on 
  3.11  the estimated number of students the school district or charter 
  3.12  school expects to serve under this section. 
  3.13     [EFFECTIVE DATE.] This section is effective for revenue for 
  3.14  fiscal year 2003 only. 
  3.15     Sec. 2.  Laws 2001, First Special Session chapter 6, 
  3.16  article 4, section 27, subdivision 9, is amended to read: 
  3.17     Subd. 9.  [REIMBURSEMENT FOR WEB-BASED AND INDEPENDENT 
  3.18  STUDY COURSES.] For grants to school districts and charter 
  3.19  schools for additional pupils taking on-line courses according 
  3.20  to section 25: 
  3.21       $100,000     .....     2002 
  3.22     This appropriation is available until June 30, 2003.
