  1.1                          A bill for an act 
  1.2             relating to economic development; establishing an 
  1.3             enterprise account for revenues and expenditures 
  1.4             associated with the Giants Ridge Recreation Area; 
  1.5             amending Minnesota Statutes 2002, section 298.221. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 298.221, is 
  1.8   amended to read: 
  1.9      298.221 [RECEIPTS FROM CONTRACTS; APPROPRIATION.] 
  1.10     (a) Except as provided in paragraph (c), all money paid to 
  1.11  the state of Minnesota pursuant to the terms of any contract 
  1.12  entered into by the state under authority of section 298.22 and 
  1.13  any fees which may, in the discretion of the commissioner of 
  1.14  iron range resources and rehabilitation, be charged in 
  1.15  connection with any project pursuant to that section as amended, 
  1.16  shall be deposited in the state treasury to the credit of the 
  1.17  Iron Range Resources and Rehabilitation Board account in the 
  1.18  special revenue fund and are hereby appropriated for the 
  1.19  purposes of section 298.22. 
  1.20     (b) Notwithstanding section 16A.013, merchandise may be 
  1.21  accepted by the commissioner of the Iron Range Resources and 
  1.22  Rehabilitation Board for payment of advertising contracts if the 
  1.23  commissioner determines that the merchandise can be used for 
  1.24  special event prizes or mementos at facilities operated by the 
  1.25  board.  Nothing in this paragraph authorizes the commissioner or 
  2.1   a member of the board to receive merchandise for personal use.  
  2.2      (c) All fees charged by the commissioner in connection with 
  2.3   public use of the state-owned ski and golf facilities at the 
  2.4   Giants Ridge Recreation Area and all other revenues derived by 
  2.5   the commissioner from the operation or lease of those facilities 
  2.6   and from the lease, sale, or other disposition of undeveloped 
  2.7   lands at the Giants Ridge Recreation Area must be deposited into 
  2.8   an Iron Range Resources and Rehabilitation Board account that is 
  2.9   created within the state enterprise fund.  All funds deposited 
  2.10  in the enterprise fund account are appropriated to the 
  2.11  commissioner to be expended, subject to approval of a majority 
  2.12  of the board, as follows: 
  2.13     (1) to pay costs associated with the construction, 
  2.14  equipping, operation, repair, or improvement of the Giants Ridge 
  2.15  Recreation Area facilities or lands; 
  2.16     (2) to pay principal, interest and associated bond 
  2.17  issuance, reserve, and servicing costs associated with the 
  2.18  financing of the facilities; and 
  2.19     (3) to pay the costs of any other project authorized under 
  2.20  section 298.22.
