  1.1                          A bill for an act 
  1.2             relating to Minnesota Point; Duluth; requiring a 
  1.3             report on the legal status of lands conveyed to the 
  1.4             city of Duluth by the state and federal governments 
  1.5             for purposes of public recreation and health. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [STUDY OF STATE RECREATION AREA POTENTIAL.] 
  1.8      Subdivision 1.  [DETERMINATION OF LEGAL STATUS OF 
  1.9   LANDS.] The department of natural resources in consultation with 
  1.10  the attorney general shall conduct a study of the legal status 
  1.11  of public lands on Minnesota Point conveyed by the state and 
  1.12  federal governments to the city of Duluth and whether the city 
  1.13  of Duluth has complied with the conditions of the 1939 
  1.14  conveyance by the state to the city.  The report must include: 
  1.15     (1) consideration of the extent to which operation and 
  1.16  proposed expansion of certain features of an existing airport 
  1.17  are consistent with the conditions of the conveyance; 
  1.18     (2) the conformity of certain sales, leases, and permits 
  1.19  for the use of lands within and adjacent to conveyed lands to 
  1.20  conditions of the conveyance; 
  1.21     (3) the legal status of all public lands on Minnesota 
  1.22  Point; 
  1.23     (4) a determination of whether conditions of the conveyance 
  1.24  may be said to have been breached; 
  1.25     (5) the appropriate classification of public lands should 
  2.1   the determination be made that conditions of the conveyance have 
  2.2   been breached; and 
  2.3      (6) advisable action by the department of natural resources 
  2.4   or other state agencies to ensure that the designation and use 
  2.5   of public lands on Minnesota Point are consistent with Minnesota 
  2.6   statutes concerning protection of wetlands, plant communities, 
  2.7   old growth forests, rare and endangered species habitats, 
  2.8   seasonal bird flyways and habitats, natural landscapes, historic 
  2.9   sites, and other aspects of Minnesota's environment. 
  2.10     Subd. 2.  [DATE OF REPORT.] This report is due within one 
  2.11  year of the effective date of this provision.
