  1.1                          A bill for an act 
  1.2             relating to insurance; requiring infertility treatment 
  1.3             coverage; proposing coding for new law in Minnesota 
  1.4             Statutes, chapter 62A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [62A.0411] [INFERTILITY TREATMENT COVERAGE.] 
  1.7      A health plan that provides coverage of or reimbursement 
  1.8   for pregnancy related benefits must provide, to the same extent 
  1.9   that benefits are provided for other pregnancy related 
  1.10  procedures, or other disease, coverage for all infertility 
  1.11  related procedures for the diagnosis and treatment of 
  1.12  infertility considered necessary by the insured's physician, and 
  1.13  recognized by either the American Society for Reproductive 
  1.14  Medicine or the American College of Obstetrics and Gynecologists.
  1.15     The covered procedures include, but are not limited to, 
  1.16  ovulation induction, ovulation monitoring procedures and 
  1.17  devices, artificial insemination, oocyte retrieval procedures, 
  1.18  in vitro fertilization, gamete intrafallopian transfer, oocyte 
  1.19  replacement, cryopreservation techniques, and micromanipulation 
  1.20  of gametes.  Procedures requiring testing of, or participation 
  1.21  by both the insured and the insured's spouse shall be covered by 
  1.22  the policy or plan of each as considered necessary by the 
  1.23  physician of either.  Coverage of surgical reversal of elective 
  1.24  sterilization and expenses related to purchase of donor gametes 
  1.25  is not required by this section.  Copayments and deductibles for 
  2.1   the infertility coverage may not be greater than any copayments 
  2.2   or deductibles for maternity coverage under the health care plan.
  2.3      For the purposes of this section "infertility" is defined 
  2.4   as:  a disease affecting the reproductive system, that 
  2.5   interferes with the ability of a man or woman to achieve a 
  2.6   pregnancy; or the decreased ability of a woman to carry a 
  2.7   pregnancy to a live birth. 
  2.8      For purposes of this section, "health plan" includes 
  2.9   coverage that is excluded under section 62A.011, subdivision 3, 
  2.10  clause (7), and coverage issued by a community integrated 
  2.11  service network or an integrated service network. 
  2.12     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  2.13     Section 1 is effective the day following final enactment, 
  2.14  and applies to all health plans issued or renewed to provide 
  2.15  coverage to Minnesota residents on or after that date.
