  1.1                          A bill for an act 
  1.2             relating to settlements; authorizing settlement of a 
  1.3             lawsuit for age discrimination; implementing a 
  1.4             settlement with extended employment program services 
  1.5             providers; transferring appropriations; appropriating 
  1.6             money. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [AGE DISCRIMINATION SETTLEMENT.] 
  1.9      $250,000 of appropriations made to the corrections 
  1.10  ombudsman is available to settle an age discrimination lawsuit 
  1.11  against the ombudsman.  To support this appropriation, the 
  1.12  following appropriations are transferred and added to the 
  1.13  appropriation to the corrections ombudsman in Laws 1995, chapter 
  1.14  226, article 1, section 12, for fiscal year 1996:  $15,000 is 
  1.15  transferred from the ombudsman's appropriation in Laws 1995, 
  1.16  chapter 226, article 1, section 12, for fiscal year 1997, and 
  1.17  $225,000 is transferred from the appropriation for tort claims 
  1.18  in Laws 1995, chapter 254, article 1, section 28, the amount to 
  1.19  be taken from each fiscal year to be determined by the 
  1.20  commissioner of finance. 
  1.21     Sec. 2.  [EXTENDED EMPLOYMENT PROGRAM SERVICES SETTLEMENT.] 
  1.22     Subdivision 1.  [PURPOSE.] The purpose of this section is 
  1.23  to implement a settlement agreement between the department of 
  1.24  economic security, rehabilitation services branch, and certain 
  1.25  providers of extended employment program services.  
  1.26  Implementation of the agreement will resolve disputed audits for 
  2.1   fiscal years 1991, 1992, and 1993, those audits having recently 
  2.2   been completed by the department of economic security pursuant 
  2.3   to a schedule set out in Laws 1995, chapter 224.  Settlement of 
  2.4   the fiscal years 1991 to 1993 audits, in conjunction with 
  2.5   implementation of an audit procedure to expedite the completion 
  2.6   of audits for fiscal years 1994 and 1995 as provided for in this 
  2.7   act, will resolve all disputed audits, and necessary 
  2.8   reconciliations, by June 30, 1997. 
  2.9      Subd. 2.  [INDEPENDENT AUDITS AUTHORIZED.] Extended 
  2.10  employment service providers must secure an independent outside 
  2.11  audit for fiscal years 1994 and 1995 using audit standards 
  2.12  provided by the rehabilitation services branch of the department 
  2.13  of economic security and submit the reports of the audits to the 
  2.14  rehabilitation services branch by May 1, 1996. 
  2.15     Subd. 3.  [DEADLINE FOR ISSUING 1994 AND 1995 
  2.16  RECONCILIATION.] Ninety days after the receipt of all the audit 
  2.17  reports for fiscal years 1994 and 1995, the rehabilitation 
  2.18  services branch shall issue a notice of reconciliation to each 
  2.19  extended employment service provider for each of the fiscal 
  2.20  years. 
  2.21     Subd. 4.  [RECONCILIATION COMPLETION.] Any funds paid to or 
  2.22  among extended employment service providers as a result of 
  2.23  fiscal years 1994 and 1995 reconciliation and completion of 
  2.24  appeals for 1991, 1992, and 1993, must take place by June 30, 
  2.25  1997, or at the completion of all appeals, whichever is later. 
  2.26     Subd. 5.  [APPROPRIATION.] $725,000 is appropriated from 
  2.27  the general fund to the commissioner of economic security to 
  2.28  implement the settlement agreement between the department of 
  2.29  economic security, rehabilitation services branch, and certain 
  2.30  providers of extended employment program services. 
  2.31     Sec. 3.  [EFFECTIVE DATE.] 
  2.32     This act is effective the day following final enactment.
