  1.1                          A bill for an act 
  1.2             relating to crime; establishing jurisdiction to 
  1.3             prosecute criminal sexual conduct offenses and 
  1.4             solicitation to engage in sexual conduct offenses in 
  1.5             the state where they originate or terminate; amending 
  1.6             Minnesota Statutes 1998, section 609.352, subdivisions 
  1.7             1 and 2; proposing coding for new law in Minnesota 
  1.8             Statutes, chapter 609. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 609.352, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [DEFINITIONS.] As used in this section: 
  1.13     (a) "child" means a person under the age of 15 years of age 
  1.14  or younger; 
  1.15     (b) "sexual conduct" means sexual contact of the 
  1.16  individual's primary genital area, sexual penetration as defined 
  1.17  in section 609.341, or sexual performance as defined in section 
  1.18  617.246; and 
  1.19     (c) "solicit" means commanding, entreating, or attempting 
  1.20  to persuade a specific person in any manner, including in 
  1.21  person, by telephone, by letter, or by computerized or other 
  1.22  electronic means. 
  1.23     Sec. 2.  Minnesota Statutes 1998, section 609.352, 
  1.24  subdivision 2, is amended to read: 
  1.25     Subd. 2.  [PROHIBITED ACT.] A person 18 years of age or 
  1.26  older who solicits a child or someone the person reasonably 
  1.27  believes is a child to engage in sexual conduct with intent to 
  2.1   engage in sexual conduct is guilty of a felony and may be 
  2.2   sentenced to imprisonment for not more than three years, or to 
  2.3   payment of a fine of not more than $5,000, or both. 
  2.4      Sec. 3.  [609.353] [JURISDICTION.] 
  2.5      A violation or attempted violation of section 609.342, 
  2.6   609.343, 609.344, 609.345, 609.3451, or 609.352 may be 
  2.7   prosecuted in any jurisdiction in which the violation originates 
  2.8   or terminates. 
  2.9      Sec. 4.  [EFFECTIVE DATE.] 
  2.10     Sections 1 to 3 are effective August 1, 2000, and apply to 
  2.11  crimes committed on or after that date.
